With the arrival of the Fourth Industrial Revolution, various technologies are developing not only in the conventional technical fields but also in new fields and fusion / complex fields. In particular, artificial intelligence (AI) is rapidly growing in technological fields such as the Internet of Things (IoT), robot technology, drones, autonomous vehicles, and virtual reality (VR). In particular, there is a lot of interest in the current state of securing intellectual property rights related to AI. Existing Examination System We are modifying the examination system in some countries where it is not easy to examine patents related to AI. In line with this trend, the Korean Patent Law has also been partially amended to present improved guidelines for patents related to AI.
In this paper, we will consider measures as to what kind of strategy is necessary for South Korea to secure patents strongly related to AI as a patent power.
4차 산업혁명을 맞아 전통적인 기술분야 뿐 아니라 새로운 분야 및 융/복합 분야에서 다양한 기술들이 발전하고 있다. 특히, 인공지능(AI), 사물인터넷(IoT), 로봇 기술, 드론, 자율주행차, 가상현실(VR) 등의 기술분야가 빠르게 성장하고 있다. 특히, AI와 관련된 지식재산권의 확보현황에 대하여 다양한 관심이 모이고 있다. 기존의 AI와 관련된 특허에 대한 심사가 용이하지 않아 여러 국가에서 심사체계를 수정하고 있다. 이러한 흐름에 맞추어 한국 특허법도 일부 개정을 통해 AI와 관련된 특허에 대한 개선된 지침을 제시하였다.
본 논문에서는 이러한 흐름속에서 우리나라가 특허 강국으로서 AI와 관련된 강한 특허를 확보하기 위해 어떠한 전략이 필요한지 고찰해보고자 한다.
