With the development of artificial intelligence, the field to which artificial intelligence is applied expands to the activity of ‘creating’, there is an active argument about whether invention generated by artificial intelligence can be legally protected, and if so, who is the owner of the invention legally, who is responsible for the infringement problem. Accordingly, many studies on the handling of inventions generated by artificial intelligence under patent law have been preceded. In this study, on the premise that inventions generated by artificial intelligence are also subject to protection under the patent law, I would like to present the necessity of changing the criteria for determining the inventive step in the examination of the inventive step of artificial intelligence with focusing on the interpretation of ‘The Skilled Person’.
인공지능의 발달에 따라 인공지능이 적용되는 분야가 창작이라는 활동에까지 넓혀지면서, 인공지능에 의해 만들어진 발명이 법적으로 보호받을 수 있는 대상인지, 만약 그러하다면 법적 권리주체는 누구인지, 침해문제에 있어 책임을 지는 주체는 누구인지 등에 대한 논의가 활발히 전개되고 있다. 이에 따라, 인공지능에 의한 발명에 대한 특허법상 취급에 대한 많은 연구가 선행되어 왔다. 본 연구에서는 인공지능에 의하여 이루어진 발명 또한 특허법상 보호 대상이 됨을 전제로 하여, 인공지능 발명의 진보성 심사에 있어서 진보성 판단 기준의 변화 필요성 및 그 방안을 통상의 기술자에 대한 해석을 중심으로 제시하고자 한다.
