Laws interact and change with society. Laws function as legal norms by being influenced by society, enacted, interpreted, and reapplied to society. However, the reality is that the effectiveness of laws created through the legislative process varies from law to law. If the law is not complied with and not implemented, the significance of the existence of the law is lost. Therefore, it is an important issue to understand the actual implementation of the current laws.
Laws have a hierarchical system between laws and regulations depending on where they received the basis for their existence as legal norms. In the process of legal application, it follows the principle that the higher law usually takes precedence over the lower law, the new law over the old law, and the special law over the general law. Many individual laws and regulations are arranged purposefully, logically, and conveniently in this way to form a legal order, but with this legal system alone, it is difficult to understand what the laws that actually govern human behavior in everyday social life are and how much influence they have. In this study, as a process in which laws arise a priori and formally in the existing legal system, the laws of mutatis mutandis, which are one of the legislative technologies, are posited, and as a substantive law in contrast to this, reference articles that are the basis for judicial interpretation in court decisions are examined. It attempts to analyze the effectiveness of the law by presenting it.
In network science, the object or phenomenon of research is expressed as a network, and hidden information is identified and the phenomenon expressed is interpreted. This study visualizes the relations of mutatis mutandis and reference relations of precedents, respectively, using network theory, and quantifies and analyzes the extent to which laws are realized in this society through derivation of basic structure and morphological characteristics of laws expressed as networks.
Through this study, by comparing and analyzing the network characteristics of laws in the process of law creation and application, it was possible to structure laws that were on the same level under the existing legal system by differentiating them according to their effectiveness. The law should seek harmony with both the characteristics of the quantum in the middle between the ideal and the reality, the norm and the fact. Therefore, research on the hierarchical structure by measuring the practical impact of laws can contribute to visualizing the reality of the law and reorganizing and supplementing the process of making effective laws.
법은 사회와 상호작용하며 변화한다. 법은 사회에서 영향을 받아 제정되고, 해석되어, 사회에 다시 적용됨으로써 법규범으로 기능한다. 하지만 입법 과정을 통해 만들어진 법의 실효성은 법마다 차이가 있는 것이 현실이다. 법으로 정한 것이 준수되고, 그 제재가 실현되지 않는다면 법의 존재 의의는 상실되므로, 현행 법률들의 실질적인 실현 정도를 파악하는 것은 중요한 문제이다.
법령은 법규범으로서의 존재 근거를 어디서부터 받았는가에 따라 법령 상호 간의 위계체계를 가지고 있고, 법적용 과정에서는 통상적으로 상위법이 하위법에, 신법이 구법에, 특별법이 일반법에 각각 우선하여 적용한다는 원칙을 따르고 있다. 많은 개개의 법규들은 이렇게 목적적⋅논리적⋅편의적으로 배열되어 법질서를 형성하고 있지만, 이러한 법체계만으로는 일상의 사회생활에서 인간의 행위를 실질적으로 규율하는 법이 무엇인지, 그 영향력이 어느 정도인지 파악하기는 어렵다. 본 연구는 기존 법체계에서 선험적⋅형식적으로 법이 발생하는 과정으로서 입법기술의 하나인 준용 관계의 법률들을 상정하고, 이와 대비되는 실체적 측면의 법률로서 법원 판결에서 사법해석의 근거가 되는 참조조문을 제시하여 법의 실효성에 대해 분석한다.
네트워크 과학은 연구의 대상이나 현상을 네트워크로 표현하고 숨겨진 정보를 파악하여 발현하는 현상을 해석하는 학문이다. 준용 관계의 법률, 판례의 참조법률 관계의 법률들을 각각 네트워크 이론을 활용하여 시각화하고, 네트워크로 표현된 법률들의 기본 구조와 형태적 특징 도출을 통해 법이 이 사회에 실현되는 정도를 계량화하여 분석했다.
본 연구를 통해 법의 생성 과정과 적용 과정에 있는 법률의 네트워크 특성을 비교 분석함으로써 기존 법체계 하에 동위 관계에 있던 법률들을 그 실효성에 따라 법률을 차등하여 구조화할 수 있었다. 법이 이념과 실재, 규범과 사실의 중간에서 양자적 특성을 모두 가지고 조화를 추구해야한다는 점에서 법률의 실질적 영향력 측정과 위계구조 제안은 법현실을 시각화하고 실효성 있는 법률의 입안 과정을 정비하고 보완하는데 기여할 수 있을 것이다.
