The U.S. has protected unregistered Trade Dress by Lanham Act 43(a) since 1988. Trade Dress is not only the image of the product packaging but also the total image of the business which plays an important role to protect interior and fashion designs.
However, Korea has not yet stipulated Trade Dress protection provision. In addition, the related laws are still controversial whether to protect unregistered designs as a Trade Dress.In Literature Review, most of the journal articles were about research of the concepts of Trade Dress and analysis of Trade Dress system in U.S.Through the comparative analysis of Trade Dress between the U.S. and Korea, it could be ultimately meant to adopt Trade Dress System and suggest revision on the Unfair Competition Prevention Act of Korea that will promote fair competition and protect producers’ rights as well.
미국은 1988년부터 연방상표법 제43조(a)에 의하여 미등록 트레이드 드레스를 보호해오고 있다. 트레이드 드레스는 상품포장의 이미지를 의미할 뿐만 아니라 인테리어와 패션디자인을 보호할 수 있는 중요한 역할을 하는 사업의 총체적 이미지도 포함하고 있다. 그러나 한국은 트레이드 드레스를 명문으로 규정하고 있지 아니하며 관련규정이 등록하지 아니한 표지 등을 미등록 트레이드 드레스로 보호하는지에 관하여 여전히 논의의 대상이 되고 있다. 이 번 연구에 앞서 사전 조사로 살펴본 대부분의 논문들이 미국의 트레이드 드레스의 개념이나 제도의 분석이 주였다. 이번 연구에서 미국과 한국의 트레이드 드레스에 관한 비교분석을 통해 공정한 경쟁을 도모하고 아울러 제작자의 권리를 보호하기 위해 한국에 트레이드 드레스제도를 도입하여 그에 따른 부정경쟁방지법에 대한 개정 방안을 제시하고자 한다.
