When calculating the compensation for job inventions in the precedents, three considerations have been applied: “User’s benefits”, “Inventor’s contribution rate” and “Inventor’s share ratio”. However, some of the considerations in the precedents have factors that are somewhat unreasonable in calculating the value, hindering the fair compensation for job inventions. This thesis proposes and considers a method to solve the problems of such precedents by dealing with like "a study on patent apportionment ratio when calculating user benefits", "a study on consideration of combined inventions when calculating inventor’s contribution rate", and "a study on overlapping factors of calculation of the considerations".
선행 판례에서 직무발명 보상금 산정할 때, “사용자가 얻을 이익”, “발명자 공헌도” 및 “발명자 기여율”의 3가지의 고려사항을 적용하고 있다. 하지만, 선행 판례의 고려사항 중 일부는, 그 값을 산정함에 있어 다소 합리적이지 못한 요소들이 존재하여 정당한 직무발명 보상을 저해하고 있다. 본 학위논문은, 이러한 선행판례의 문제점을 해결하기 위한 방법을 제시 및 고찰하는 것으로, 사용자 매출액 산정 시 특허발명 기여율 연구, 발명자 기여율 산정 시 조합 특허발명 고려 연구, 당해 고려사항의 산정 요소들의 중복적용 연구 등을 다루고자 한다.
