The purpose of this paper is to predict the effects of creating works through artificial intelligence on the copyright ecosystem in the future and to establish strategies for them. For this purpose, I develop research through various academic approaches and international comparisons with futuristic perspectives based on recent studies related to creations through artificial intelligence. I predict changes in the concept of future copyright by comparing the characteristics of human creations with those of artificial intelligence the technological advancement of artificial intelligence and the development of brain science have shown. By illuminating the characteristics and existing cases of creation using machines, I find the status and meaning of creation using artificial intelligence as an artistic innovation, and organize copyright issues surrounding it to open the possibility of future discourse. In doing so, I anticipate changes in the meaning of works and copyrights, changes in members' status and interests, changes in institutions and structures, and new legal phenomena in the future copyright ecosystem. Finally, I present a number of future strategies for the future copyright ecosystem to survive developmentally in the midst of the inevitable and unlimited creation of works through artificial intelligence.
본 논문의 목적은 인공지능을 통한 작품 창작이 미래 저작권 생태계에 미칠 영향들을 예측하고 그에 대한 전략을 수립하는 것이다. 이를 위하여 인공지능 창작과 관련된 최근의 연구들을 섭렵한 바탕 위에 미래학적 관점을 가지고 다양한 학문적 접근과 국제적 비교를 통한 연구를 전개한다. 인공지능의 기술적 발전과 뇌과학 연구 결과가 보여주는 인간의 창작물과 인공지능 작품의 특징을 비교해 봄으로써 미래 저작권의 관념 변화를 예측한다. 기계를 이용한 창작의 특성과 기존 사례를 조명하여 예술적 혁신으로서의 인공지능 활용 창작의 지위와 의미를 찾아내고, 이를 둘러싼 저작권적 쟁점들을 정리하여 미래 담론의 가능성을 열어간다. 이로써 미래 저작권 생태계에서 저작물 및 저작권의 의미 변화와 구성원들의 지위 및 이해관계 변화, 제도 및 구조의 변경, 새롭게 나타날 법현상 등을 예측한다. 마지막으로 피할 수 없는 인공지능을 통한 무제한의 작품 창작 속에 미래 저작권 생태계가 발전적으로 존속할 수 있는 여러 가지 미래 전략을 제시한다.
