With the gradual development of intellectual property rights and the growing number of disputes, the need for protection of intellectual property rights is emerging. If the intellectual property rights of a legitimate right holder are protected from the boundaries of the law and infringed or damaged, he or she shall be compensated by the perpetrator as a victim. It is questionable whether it is appropriate to rescue victims, even though the nation's intellectual property law stipulates compensation for damages in the event of rights violations. To compensate for this, the punitive damages from the Anglo-American legal system were first introduced to the Patent Act in 2018 among the Intellectual Property Rights Act in Korea, which takes over the continental legal system, and will then be introduced to the Trademark Act. In this thesis, I would like to consider the matters to be considered in introducing the punitive damages system under the Korean Trademark Act and to address suggestions for effective system operation.
지식재산권이 점차 발전하고 분쟁도 증가하면서 지식재산권 보호의 필요성이 대두되고 있다. 정당한 권리자의 지식재산권을 법의 테두리에서 보호받고 침해를 당하거나 손해를 입었을 경우 피해자로서 가해자로부터 응당 배상을 받아야 한다. 우리나라 지식재산권법상 권리 침해 시 손해배상에 대한 규정이 있음에도 피해자를 구제하는데 적절한지에 대해서는 의문이다. 이를 보완하기 위해, 대륙법계를 취하는 우리나라 법에 영미법계 제도인 징벌적 손해배상 제도를 지식재산권법 중 2019년 특허법에 우선 도입하였고, 이어서 상표법에도 도입 예정이다. 본 학위논문에서는 우리나라 상표법상 징벌적 손해배상 제도를 도입하면서 고려해야 할 사항을 비교법적 분석을 통해 고찰하고, 실효성 있는 제도 운영을 위한 제언 등을 다루고자 한다.
