Recently, joint research and development among enterprises, government agencies and universities has been on the rise. In the current industry, joint research and development between conglomerate and SMEs is actively carried out because small and medium-sized enterprises are unable to develop themselves due to a lack of funds and high-quality human resources required for their own development, especially for large companies to limit their facilities and avoid a simple work of high-quality human resources. As a result, there are many sharing patents, and according to a recent ruling, it is possible to divide the payment by sale. This, however, would end the patent rights of existing shares, causing undue damage to those in place and those who do not want to split. Therefore, in this study, we will study ways to improve this.
최근 기업, 정부기관, 대학 간의 공동 연구 개발이 증가하고 있다. 현 산업계에서는 특히 대기업은 보유 설비의 한계, 고급 인력의 일반 단순 작업 회피 등을 위하여, 중소기업은 자체적인 개발에 필요한 자금, 고급 인력 등의 부족으로 스스로의 개발이 어렵기에 기업 간 공동개발이 활발히 이루어지고 있다. 그로 인해 공유특허가 많이 발생하고 있는데 최근 판례에 따르면 공유특허의 경우 매각에 의한 대금 분할이 가능하다 하였다. 하지만 이로 인해 기존 공유자들의 특허권리는 소멸하게 되므로 실시 중인 공유자와 분할을 원하지 않는 공유자에게는 불의의 손해를 입히게 된다. 따라서 본 연구에서는 이를 개선할 수 있는 방안에 대하여 연구해볼 것이다.
