Lots of discussion about that which position the AI can be and which role it can be and which influence it can be affect to the society and the industry under judicial system area are progressing. I would like to cover the subject of necessity that we should grant certain legal position to AI, and the subject of method which way it will be if we grant legal position, and also the subject that how the relationship with existing system should be established if we grant legal position in this study.
사법의 영역에서 인공지능이 어떤 위치에 있을 수 있는지, 어떠한 역할을 할 수 있는지, 이를 통해 사회 및 산업에 어떠한 영향을 미칠 수 있는지에 대해서 많은 논의들이 진행되고 있다. 인공지능 기술을 거래관계에 활용하려면 인공지능의 의사표시에 법률 효과를 부여할 수 있어야 한다. 본 연구에서는 인공지능에게 일정한 법적 지위를 부여해야하는가라는 필요성의 문제, 법적 지위를 부여한다면 어떠한 방식으로 할 것인가라는 방법의 문제, 법적 지위를 부여할 경우 기존의 제도와의 관계를 어떻게 정립할 것인가 하는 정합의 문제를 다루고자 한다.
