As technology transactions are increasing, the demand for evaluation of technology is also increasing day by day. The core of evaluation of technology is to produce reliable and objective evaluation results. However, as it is basically the value of intangible assets, there is a limit to relying on estimates. Therefore, efforts to increase the reliability of technology valuation continue. The purpose of this study is to propose how to improve the method of calculating the technology apportionment ratio, which is considered important in the evaluation of technology, concerning the law of apportionment established through the legal cases calculating damages.
기술 거래가 점차 활성화됨에 따라 기술가치평가에 대한 수요는 날이 갈수록 커지고 있으며, 기술가치평가의 핵심은 신뢰성있고 객관적인 평가 결과를 도출함에 있다. 그러나 기본적으로 무형 자산의 가치를 평가하는 일인 만큼 대부분 추정값에 의존해야 하는 한계가 있으며, 이에 따라 기술가치평가의 신뢰성을 높이기 위한 노력들이 계속되고 있다. 본 연구는 기술가치평가에서 중요하게 고려되는 기술기여도의 산정 방법을, 손해 배상액 산정 판례들을 통해 정립된 기여도 법리를 통해 개선할 수 있는 방안을 제시해 보고자 한다.
