Divisional or continuation application is frequently used for establishing strong patent portfolios and it sometimes cause problems of allowing a patent with patent scope beyond the disclosure of the original patent application by deleting at least one element in a patent claim. An illegal extending the subject-matter of a divisional or continuation application cause unexpected risks to third parties due to illegal and broad patent scope and also may conflicts with other patents which are filed later and its patent scope is entirely or partially overlapped with earlier divisional or continuation application. This thesis investigates some real cases of illegal extending of subject- matter in razor technical fields and reviewed relevant patent law in major countries, find causes of these problems and provide suggested examination guidelines regarding written requirement of essential elements of a claim and provide some suggestion for law revision including filing explanation, selecting category and tightening amendment rules for divisional or continuation application.
강력한 특허 포트폴리오를 구축하기 위하여 빈번히 이용되는 분할출원 또는 계속출원시 구성요소의 삭제 보정으로 최초 원출원에 개시된 내용을 벗어나는 내용으로 착오 등록되는 문제가 종종 발생하고 있다. 분할 또는 계속출원에서의 부적법한 발명 주제의 확장은 그 자체로 최초 개시된 내용을 벗어난 발명 내용으로 등록되어 제3자에게 불측의 피해를 주기도 하지만, 후출원 등록특허와 권리범위가 중첩되는 문제도 발생하고 있다. 본 학위논문에서는 면도기 기술 분야의 실제 발명 주제의 부적법한 확장 변경 사례 및 주요국의 법 제도를 검토하여 이러한 문제점이 발생하는 원인을 살펴보고 청구범위 필수구성요소 기재 관련 심사기준 개정 방향 및 분할/계속 출원에서의 심사관의 심사 부담을 경감할 수 있는 설명서 제출 제도, 카테고리 선택 제도 및 보정 규정 강화 제도를 제시한다.
