IP5 Offices are working on patent harmonization of practices and procedures, enhanced work-sharing, high-quality and timely search and examination results, and seamless access to patent information to promote an efficient, cost-effective and user-friendly international patent landscape.
At present, the patent work-sharing has been introduced and implemented for the efficiency of examination and time and cost advantages due to the increase in international patent applications and duplicate applications between countries.
This study analyzes the case of inconsistency in the patent examination result of the communication service field in which the global standards between countries, identifies problems, and suggest a improved process.
지식재산주요국들은 불필요한 프로세스를 줄이고 특허의 관행과 절차를 조화시키며, 업무로드를 줄이기 위해 향상된 업무 공조(Work-Sharing), 심사처리기간을 단축하면서 고품질의 조사와 심사를 적시에 제공하기 위하여 국제적 조화를 강조하고 있다.
현재 특허 심사공조제도는 국제 특허출원 및 국가 간 중복출원 증가로 심사의 효율성과 시간적·비용적 이점을 위해 도입하여 시행되고 있으나, 국가 간 심사 결과가 불일치하는 사례들이 있다.
본 연구에서는 국가간 글로벌 스탠다드를 맞추는 통신서비스 분야의 심사 결과 중 국가간 심사결과가 일치하지 않은 사례에 대하여 심층적으로 분석하였다.
본 연구를 통해 글로벌 특허 심사공조의 주요 제도인 국제특허조약 협력심사(PCT CS&E), 특허심사하이웨이(PPH), 및 특허 공동심사 프로그램(CSP)의 프로세스를 살펴보고, 제도 중 특허심사하이웨이(PPH)와 특허 공동심사 프로그램(CSP)에서 국가간 심사결과가 불일치한 사례를 분석하여 문제점을 도출하고, 이를 해결할 수 있는 방안을 제시한다.
