With the expiration of key patents related to 3D printers over the past five years, applications for 3D printing patents have soared, and the industry is fiercely competing to gain the upper hand in 3D printing technology, which is one of the core technologies. The spread of 3D printers is changing the distinction between traditional manufacturing areas and sales activities, foreshadowing the emergence of so-called pro-sumers. 3D printing, a breakthrough technology that makes it easy to create objects without a machine tool, can create a variety of intellectual property rights issues in that it is now easy to share even objects over the Internet, as anyone can easily produce the desired items through a 3D printer. Accordingly, we would like to examine the issues of action, including the drawing and transmission of 3D modeling data, and how to protect patent inventions from patent infringement that may result from 3D modeling data in the 3D printing ecosystem.
지난 5년간 3D 프린터와 관련된 핵심 특허가 만료됨에 따라 3D 프린팅 특허 출원이 급증하였고, 업계에서는 핵심 기술로 꼽히는 3D 프린팅 기술을 선점하기 위해 치열한 경쟁을 벌이고 있다. 3D 프린터의 보급은 전통적인 제조 영역과 판매 활동의 구분을 바꾸며 소위 프로슈머(Prosumer)의 등장을 예고하고 있다. 공작 기계 없이도 물체를 간편하게 제작할 수 있는 점에서 획기적인 기술인 3D 프린팅은 3D 데이터 파일만 가지고 있다면, 누구나 3D 프린터를 통해 원하는 물품을 손쉽게 제작할 수 있기 때문에 이제는 유형물조차 손쉽게 인터넷을 통해 공유할 수 있다는 점에서 다양한 지식재산권 문제가 발생할 수 있다. 이에 따라 근 미래의 시점에서 3D 데이터 파일의 작성 및 전송을 포함한 행위 태양에 있어서 문제가 되는 쟁점과 3D 프린팅 생태계에서 3D 데이터로 인해 발생할 수 있는 특허권의 침해로부터 특허 발명을 보호하기 위한 방안에 대해 검토해보고자 한다.
