With the recent increase in the number of composite trademarks (combining three-dimensional shapes and letters etc.), there are many cases in which the non-distinctive portion of registered trademarks is claimed to have exclusive rights as a trademark that it has been registered. Misuse of Trademark Rights is currently being applied in order to solve these problem.
However, since it could be an escape to the general clause of the Civil Act, this study examines a reintroduction of the Disclaimer system, which was introduced at the time of our enacted Trademark Act and abolished.
To this end, we will analyze the domestic operation of the Disclaimer system and the status of overseas operation focusing on the U.S. and Japan, and propose the direction of the system so that it can be settled according to our current situation.
최근 입체적 형상과 문자 등이 결합되는 결합상표가 증가하면서, 전체상표가 등록되었음을 기화로 등록상표 중 식별력이 없는 부분에 관하여도 배타적인 권리를 주장하는 사례가 적지 않다. 이와 같은 문제를 해결하기 위하여 현재 상표권 남용의 법리가 적용되고 있다.
그러나 이는 민법 일반조항으로의 도피라는 한계를 가지므로, 본 연구에서는 우리 제정 상표법 당시 도입되었다가 폐지된 권리불요구제도의 재도입에 대하여 검토한다. 이를 위하여 권리불요구제도의 국내 운용 과정과 미국과 일본을 중심으로 국외 운용 실태를 분석하여 지금 우리의 상황에 맞는 제도가 정착될 수 있도록 그 방향을 제시하고자 한다.
