With the development of IT technology and the Fourth Industrial Revolution, the traditional border and the idea of the singular country are fading; the market as well is becoming globalized and unified. As a result, there are many transnational issues that cannot be dealt with by using only the patent law system of a country based on the territorial principle. Based on increasingly transnational movements, various communities have been built based on agreements or treaties in accordance with political, economic, social, and cultural interests. This study examines the necessity of the Northeast Asian patent community in this environment and makes a proposal based on suggestions derived from the process of establishing the main patent community. The proposal is as follows: (i) Establishment of the Northeast Asia Intellectual Property Exchange, (ii) Signing of 'The International Jurisdiction Agreement, Approving and Enforcement of Foreign Decisions on Intellectual Property Right' in the center of Northeast Asia, (iii) Establishment of a transitional patent examination and cooperation model conforming to Northeast Asian standards, and (iv) Establishment of a Task Force Team (TFT) centered on academia and the legal profession, proposed to engage in the promotion of the Northeast Asian patent community. In addition, as a way for Korea to take the lead in the discussion of establishing a patent community in Northeast Asia, and to drive China and Japan's participation, it is proposed that the following measures should be taken: (i) Establishment of the International Patent Court (IPC), (ii) Enhancement of the evidence collection system of patentees, and (iii) Introduction of a Korean-style automated preliminary examination result delivery service. The results of this study can be referenced in policy decisions for promoting the Northeast Asian patent community.
IT 기술 발달과 4차 산업 혁명으로 종래의 국경이나 국가의 의미가 퇴색되고 시장의 세계화 및 단일화가 이루어지고 있다. 이로 인해, 속지주의를 근간으로 하는 한 나라의 특허 제도만으로는 다루기 힘든 초국가적인 사안들도 많이 등장하고 있으며 이러한 움직임에 따라 정치적, 경제적, 사회적, 문화적 이해 관계에 따른 협정이나 조약을 기반으로 다양한 공동체가 구축되고 있다. 본 연구는 이러한 환경에서 동북아 특허 공동체의 필요성을 검토하고 주요 특허 공동체가 설립되는 과정에서 도출되는 시사점을 통해 그 추진 방안을 제안하였다. 구체적으로, 통합 특허청 또는 통합 특허 법원을 설립한 주요 특허 공동체 추진 과정에서의 경제적 여건 및 사법적 여건을 중심으로 시사점을 도출하고, 이를 기반으로, (i) 동북아 지식재산거래소 설립, (ii) 동북아 중심의 '지식재산권에 관한 국제관할합의, 외국 판결 승인 및 집행에 관한 협약' 체결, (iii) 동북아 기준에 맞는 과도기적 특허 심사 협력 모델 마련 및 (iv) 학계 및 법조계 중심의 TFT를 마련하는 방안이 동북아 특허 공동체 추진을 위하여 필요하다는 점을 제안하였다. 또한, 한국이 동북아 특허 공동체 설립 논의를 주도적으로 이끌어가면서 중국과 일본의 참여를 견인하기 위한 과제로 (i) 국제 특허 법원의 설치, (ii) 특허권자의 증거 수집 제도 강화 및 (iii) 한국형 자동화된 예비 심사 결과 제공 서비스 도입을 제안하였다. 본 연구 결과는 동북아 특허 공동체의 추진을 위한 정책 판단 시 참조될 수 있을 것이다.
