The fourth industrial revolution has foreseen a major change in the way we live. The big data, the Internet of things and the artificial intelligence environment are mentioned as a new growth axis of IT technology, but these technologies have both positive and negative effects on individuals. In particular, the protection and utilization of data between countries on the cloud is occuring in various ways. As a result, the importance of personal information is increasing. However, there is still insufficient understanding of how much data can be protected and utilized in preparation for such a rapidly chaning environment. To explore the scope of protection, we need to look at what the nature of data is, and also examine the legal and institutional aspects of utilizing data. In this paper, I would study the data transfer problem among the major technologies of the 4th industrial revolution, focusing on the rapidly-used technologies on the cloud, focusing on the transfer articles among the countries.
최근 4차 산업 혁명은 우리의 생활에 큰 변화를 예고 하고 있다. 사물인터넷, 빅데이터, 인공지능 기술은 국가 산업기술의 신성장 동력으로서 거론되고 있지만 이러한 기술들은 개인들에게 긍정적 영향을 주기도 하지만 한편으로는 부정적 영향도 주고 있다. 그 중에서도 클라우드상의 국가간 데이터의 보호와 활용 문제는 다양한 방식으로 발생하고 있다. 이에 따라 개인고유의 데이터의 중요성도 점차 커지고 있는 추세에 있다. 그러나 이러한 급변하는 환경에 대비하여 데이터가 어디까지 보호되고 활용될 수 있는지에 대한 이해는 아직까지 부족한 현실이다. 데이터의 보호범위를 탐구하기 위해서는 데이터의 본질이 무엇인지에 대하여 살펴볼 필요가 있고, 또한 데이터를 활용하기 위한 법, 제도적인 부분을 살펴볼 필요도 있다.
이 연구에서는 이러한 4차 산업혁명의 주요 기술들 중 클라우드상에 최근 급속히 활용되는 기술들을 중심으로, 국가간 데이터 이전 문제를 유럽과 한국의 데이터 역외이전 조항 중심으로 살펴보고자 한다.
