With the development of technologies such as automation, computerization, artificial intelligence, big data, Internet of Things, block-chain and others, value-neutral digital codes have directly or indirectly affected rights and obligations, and their scope is gradually expanding and rapidly. This phenomenon works as a net function of overcoming the limitations of human abilities and solving problems scientifically and quickly, but it also evokes a vague fear of a digital-code-controlled society, or Big Brother. The main reason for this fear is that it is difficult to understand the legal actions of digital codes of '0' and '1'. As a way of solving this, we propose type classification of the legal actions of digital codes and try to draw up legal issues based on their nature. In other words, the government wants to find ways to minimize adverse effects by studying how digital codes are applied in law to bring about changes in their role, and from what point of view are the properties of the specific actions of digital codes from the perspective of rights and obligations, what should be identified and analyzed, and what causes adverse functions are common and what causes them to seek legal meaningful classifications. These studies could not only be used as a framework for analysis of the roles and attributes of digital codes in the legal domain, but would also help to preemptively derive legal problems, making vague anxiety about digital codes into controllable areas. It is also expected to contribute to understanding the relationship between technological change and legal issues by suggesting a comprehensive understanding of the functions and actions of the law and its rights and obligations caused by the advent of new technologies such as artificial intelligence, big data and block-chain.
자동화, 전산화, 인공지능, 빅 데이터, 사물인터넷, 블록체인 등 기술 발전에 따라 가치중립적인 디지털 코드가 권리·의무에 직접적 또는 간접적으로 영향을 미치면서 법 영역에 깊숙이 관여하게 되었고, 그 범위도 점차 넓고 빠르게 확대되고 있다. 이러한 현상은 인간 능력의 한계를 극복하고 과학적이며 신속하게 문제를 해결할 수 있다는 순기능으로 작동하기도 하지만 한편으로는 디지털 코드에 의한 통제 사회 즉 빅브라더에 대한 막연한 공포심도 불러일으킨다. 이러한 공포의 주원인은‘0과 1’로 이루어진 디지털 코드의 법적 작용에 대한 이해가 쉽지 않다는 점에 있는 바, 이를 해결하기 위한 방안으로 디지털 코드의 법적 작용에 대한 유형 분류를 제안하고 그 속성에 따른 법적 쟁점을 도출해 보고자 한다. 즉, 디지털 코드가 법학에서 어떻게 적용되어 어떤 역할 변화를 가져오고 있는지, 그러한 변화의 특징은 무엇인지, 권리·의무의 관점에서 디지털 코드가 가지는 구체적 작용의 속성은 무엇인지, 어떤 관점에서 그 속성을 파악하고 분석하여야 하는지, 역기능의 원인은 무엇인지를 연구하고 그 속성의 공통점을 찾아 법학적으로 의미 있는 분류를 시도함으로서 역기능을 최소화하는 방안을 찾고자 한다. 이러한 연구는 법학 영역에서 디지털 코드의 역할과 속성에 대한 분석의 틀로 활용될 수 있을 뿐 아니라 이를 통해 법적 문제를 사전적으로 도출할 수 있어 디지털 코드에 대한 막연한 불안을 통제 가능한 영역으로 만드는데 도움이 될 것이다. 또한 인공지능, 빅 데이터, 블록체인 등 신기술의 등장에 따른 법의 기능과 작용 및 권리·의무에 대한 영향을 통합적으로 이해할 수 있는 방안을 제시함으로서 기술 변화와 법학적 문제에 대한 관계를 이해하는데도 기여할 수 있을 것으로 보인다.
