The concept of ‘Person having ordinary skill in the arts’(PHOSITA) is legal fiction found in patent laws who is considered to have, or have capacity to acquire normal skills and knowledges in particular technical fields with reasonable level of creativity. Still, there is not much research on how to find out the meaning of normal level in objective and quantitative methods. In this thesis, we study on how to find out the technical level of PHOSITA; focusing on the average wages the employees working in particular technical fields. Further, we study on methods of using technicians assumed to be PHOSITA in various procedures in patent life cycle.
특허법상 ‘통상의 기술자’에 대하여 논할 때, 통상의 기술자의 수준은 모든 지식을 알거나 문헌적 지식을 자신의 것으로 만들 수 있는 보통의 창의성을 발휘할 수 있는 가상의 인물이라 하면서도 그 가상의 인물의 기술적 수준을 객관적, 정량적으로 설정할 수 있는 방법에 대한 연구는 부족한 상황이다. 본 학위논문에서는 특정 기술분야 기술자의 평균적인 기술수준을 찾기 위하여 고찰하는데, 그 방법의 일환으로 해당 기술분야에 종사하는 기술자들의 평균 임금을 활용하여 통상의 기술자 인력풀을 생성하고 특허 전주기 관련 실무에 활용하는 방법 등을 다루고자 한다.
