The block chain technology is in the early stage. Currently, the number of disclosures and registrations of block-chain patent applications is lower than in other technology fields. As the block chain technology develops, the number of patent applications will also increase. It would be meaningful to examine how the block chain patent application will be handled in the existing patent examination process at the early stage of the patent application for the block chain. In this paper, we will review the patent trend of the block chain technology. Next, we will select patent requirements (patent eligibility and non-obviousness) that will be important in the block chain patent application, and examine the handling of the block chain patent application in the patent requirements. In addition, we will propose direction of block chain patent application specification to meet the patent requirements.
블록체인 기술은 태동기에 있다. 현재 블록체인 특허출원의 공개 및 등록 건수는 타 기술 분야에 비해 적은 수준이다. 향후 블록체인 기술이 발전함에 따라 특허출원 건수도 함께 증가할 것으로 예상된다. 블록체인 특허출원의 초기 단계에서 블록체인 특허출원이 기존의 특허심사 과정에서 어떻게 취급될 것인지를 검토해보는 것은 의미가 있을 것이다. 본 논문에서는 블록체인 기술의 특허 동향을 검토할 것이다. 다음으로, 블록체인 특허출원에서 중요하게 취급될 특허요건(발명의 성립성 및 진보성)을 선정하고, 해당 특허요건에서의 블록체인 특허출원의 취급을 검토할 것이다. 또한, 선정된 특허요건을 충족시키기 위한 블록체인 특허출원 명세서의 작성 방향을 제시할 것이다.
