The current advanced digital technologies have prompted the advent of the era of Big Data. In today’s world where data is the new oil, your personal information is the most valuable commodity and asset of any organization. With the rise of Big Data, many businesses are already harnessing data and analytics to create significant value and it is no exaggeration to say that the emergence of such phenomenon has led to the rise of global data flows, thus generated public concern over the privacy of personal information. Therefore, issues relating to the protection of personal information, particularly protecting the rights of information subject should not be overlooked. The best is to remain concerned about data protection in connection with the use of personal data and, at the same time, introduce legislation, which modifies or supplements the current data protection laws. Furthermore, it is also a good idea to introduce a similar legal system of other countries, to the extent that it does not compromise the essence of the right to the protection of personal data, thereby modifying the issues in current legislation. The present study undertakes a comparative legal study to analyze the challenges of personal data protection posed by big data. First, the basic concepts and characteristics of big data will be briefly deliberated before discussing the current legislation and regulations on personal data protection. Ultimately, this study aims to suggest practical solutions through the modification to the relevant legal systems within the framework of current legislation.
IT 기술의 꾸준한 발전에 따라 마주하게 된 오늘날의 빅데이터(Big Data)시대에 있어 ‘정보’는 가장 큰 자원이자 경쟁력이며, 정보처리자는 보유한 기술을 통해 수집된 다양한 데이터를 적극 활용하여 새로운 부가가치를 창출하기 시작한지 이미 오래다. 한편, 이러한 시대적 현상은 데이터에 대한 수요를 증대시켜 자연스레 개인정보 보호에 관한 문제까지 이목을 끌게 하였는데, 헌법상의 기본권적 성격을 지닌 정보주체의 개인정보권을 보호하는 문제는 결코 경시 될 수 없는 사안이다. 가장 최선은 우선 개인정보 활용과 보호의 양 측면을 서로 상관적으로 고려하여 문제를 바라보는 것이고, 또 현행법을 적절히 수정하거나 보충하는 입법안을 한번 제시해 볼 수 있다. 나아가 본질에 크게 벗어나지 않는 범위 내에서 타법의 유사 제도를 과감히 도입하여 현행 제정법의 문제점을 시정해 보는 것 또한 참신한 방안이 될 수 있을 것이라 생각한다. 이에 본 논문은 문제해결의 초석으로 먼저 빅데이터의 개념적 특성 및 종류 등 기본적 사항에 대해 면밀히 정리 한 후 관련 법제를 실정법 테두리 안에서 적절히 수정하거나 보충하여, 보다 실용적인 해결을 도모하고자 한다.
