Intellectual property-related laws, such as patent law, have a territorial nature that operates only within a particular country, often represented by a territoriality. However, the modern industry has a form of continuous development that transcends borders. Therefore, it is a reality that the design, manufacture, and sale of goods cannot be done only in one country. In this situation, the patent infringement issue is not only infringing directly but also infringing indirect, and the subject of dispute is also expanded to the overseas market. Recently, the United States Supreme Court's ruling in relation to the patent law Section 271 (f) relating to the extraterritoriality of US patent law was in the United States in 2017 and 2018. The case law regarding the indirect infringement of US patent law and its extraterritoriality has a lot of value to look in depth for Korean manufacturing industries that have cooperation and trade with the United States. Therefore, it is also necessary to elaborate the points that Korea manufacturers should consider when working with US companies.
특허법과 같은 지식재산관련 법은 흔히 속지주의로 표현되는 특정 국가 내에서만 작동하는 영역성을 가진다. 그러나 현대의 산업은 국경을 초월하여 끊임없이 융합하면서 발전하는 형태를 띤다. 그래서 제조업만 보더라도 상품의 설계, 제조, 판매 등이 한 국가 내에서만 이루어 지지 않는 것이 현실이다. 이러한 상황에서 특허의 침해 논란도 직접침해는 물론 간접침해의 이슈가 늘어나고 그 대상도 해외시장과 관련되는 경우가 많아지고 있는 실정이다. 2017년과 2018년 미국에서는 미국 특허법의 역외적용과 연관이 있는 특허법 제 271조(f)항과 관련된 미연방 대법원의 판결이 있었다. 미국과 많은 협력과 교역을 하는 우리나라에게 미국 특허법의 간접침해 그리고 역외적용과 관련한 법률적 판단은, 그 동향을 알아보고 앞으로의 방향을 파악하기 위하여 차근차근 곱씹어볼 가치가 충분하다 하겠다. 그래서 향후 국내의 제조사 들이 미국의 기업들과 협력을 할 시 고려하여야 할 부분을 도출해 보는 것도 필요하다.
