With the advancement of information and communication technologies, the ‘phishing’ crimes utilizing phone, email, and other devices are ever increasing. Especially recently, there has been a surge of so-called ‘journal phishing’ cases, where the fake journals pirate reputation of well-known international academic journals and thereby damage such famous academic journals and innocent scholars. So this research is conducted to propose optimized legislative policies for appropriate criminal penalties, civil remedies for the victims, and prevention of further crimes. For these purposes, a complete enumeration study of a total of 1,350 decisions made by Seoul Central District Court related to traditional types of phishing crimes in the past 10 years was conducted for reviewing their punishment criteria, civil remedies, and prevention measures, which can be applied to journal phishing cases. Based on the analyses above, this research proposed enactment of (1) intellectual property owner’s obligation for consumer protection, (2) cancellation claim of domain registration, and (3) punitive damages on willful phishing cases. The logical appropriateness and applicability of such legislative proposals were examined by expert interviews.
정보통신 기술의 발전에 따라 전화와 이메일 등을 이용한 ‘피싱(phishing)’ 범죄가 증가하고 있다. 특히 최근에는 가짜 저널들이 유명 국제학술지의 명성을 도용하는 이른바 ‘저널 피싱(journal phishing)’으로 인해 학술지들과 무고한 학자들의 피해 사례가 급증하고 있다. 본 연구는 이러한 저널 피싱 범죄에 대한 적절한 형사처벌, 피해자에 대한 민사적 구제수단, 추가범죄의 예방을 위한 최적화된 입법정책을 제안하기 위한 것이다. 이를 위해 지난 10년간 서울중앙지방법원이 선고한 전통적 피싱 범죄 관련 판례 1,350건을 전수조사하여 처벌기준과 구제 및 예방수단을 분석하고, 저널 피싱에 적용 가능한 법리들을 도출하였다. 또한 국내외 문헌연구와 비교법연구를 통해 저널 피싱에 의한 피해구제의 현실화 및 추가피해 방지를 위한 입법으로서 (1) 지식재산권 소유자의 소비자보호의무, (2) 도메인등록 말소청구, (3) 징벌적 손해배상 조항의 신설을 제안하고, 전문가인터뷰를 통해 그 논리적 타당성과 실현가능성을 검토하였다.
