In the digital content market, it is most likely to occur unfair transactions, dominated by a small number of operators monopolize the platform. However, the current Fair-Trading Act has limited digital content on applying the features because it does not reflect on the industry of digital content. Also, it is insufficient state that the regulations for fair trade environment of digital content industry is abstract in the regulations of individual law and bans only few of unfair acts in general. In this dissertation, it examined the limitations of current legislation through the study of digital content industry characteristics and the case study of unfair transaction and presented the amendment of factual survey regulation and standard form contract under ICT special legislation.
디지털콘텐츠시장은 소수의 사업자가 플랫폼을 독점하고 있어 불공정거래가 발생할 가능성이 높다. 그러나 현행 공정거래 법제는 디지털콘텐츠산업의 특성을 반영하지 못해 적용에 한계가 있고, 디지털콘텐츠에 관한 개별 법령도 추상적이거나 일부의 불공정행위만 금지하고 있어서 전반적으로 디지털콘텐츠산업의 공정거래환경 조성에 관한 규정은 미비한 실정이다. 본 학위논문에서는 디지털콘텐츠산업 특성연구, 불공정거래 사례연구를 통해 이러한 현행 법제의 한계를 살펴보고 ICT특별법상 표준계약서 및 실태조사규정의 개정안을 제시하였다.
