As the global recession has prolonged and countries around the world are taking the initiative in protecting their domestic industries, the United States is tightening its trade policy around the world, including by means of antidumping, countervailing duties and safeguard measures under a newly emerging protectionist trade policy. In particular, as the US Department of Commerce has increasingly taken advantage of its discretionary power to apply Adverse Facts Available (“AFA”) by virtue of the Trade Preferences Extension Act of 2015 (“TPEA” Public Law 114-27, Sec. 502), Korean companies have increasingly been charged with high punitive tariffs. In this thesis, we will analyze examples of the application of AFA to Korean companies in the antidumping context, and evaluate the effectiveness of various possible countermeasures available to the Korean government and individual enterprises, by means of the expert interviews and questionnaires.
글로벌 경기침체가 장기화되면서 세계 각국이 자국 산업 보호에 앞장서고 있는 가운데, 미국은 新보호무역주의 정책 기조 하에 반덤핑, 상계관세, 세이프가드 등 전방위적으로 통상 규제를 강화하고 있다. 특히 2015년 무역특혜연장법(TPEA) 발효에 의해 미국 조사 당국의 AFA 적용 재량권이 대폭 늘어나면서 우리나라 기업들이 고율의 징벌적 관세를 부과 받는 사례가 증가하고 있다. 본 학위논문에서는 반덤핑 조사에서의 AFA 적용에 대한 이해를 통해 우리 기업 적용 사례를 분석하고, 전문가 인터뷰 및 설문을 바탕으로 정부와 기업의 효과적인 대응 방안을 살펴보고자 한다.
