Patent Offices and Courts of many countries (including Korea, United States and EU) have made efforts to improve Non-obviousness Standard to be more objective and predictable. Recently, Case No. 2014HUR4913 of the Patent Court of Korea suggested Reasonable Expectation of Success(RES) as a Standard for determining Non-obviousness on Medical use invention of anti-cancer. Therefore, this thesis aims to analyze the necessity of introducing Reasonable Expectation of Success Standards from Case No. 2014HUR4913 of the Patent Court of Korea to determine Non-obviousness in Korea. This thesis proceeded follows:
(1) To identify Reasonable Expectation of Success Standards from Case No. 2014HUR4913 of the Patent Court of Korea
(2) To check Reasonable Expectation of Success Standards in determining Non-obviousness of Korea and United States
(3) To review the actual meaning of Reasonable Expectation of Success Standards, and
(4) To analyze the necessity of introducing Reasonable Expectation of Success Standards in Korea
This thesis says that there is no necessity of introducing Reasonable Expectation of Success Standards to determine Non-obviousness in Korea. Because Our Patent Office and Court already apply to Reasonable Expectation of Success as a Standard for determining Non-obviousness in the actual meaning of Reasonable Expectation of Success. The actual meaning of Reasonable Expectation of Success is considering the difficulty of combination to determine Non-obviousness in order to prevent hindsight.
우리나라, 미국 및 EP를 포함한 많은 국가의 특허청과 법원은 진보성 판단의 객관성과 예측 가능성을 높이기 위하여 많은 노력을 하고 있다. 최근 특허법원 2016. 1. 21. 선고 2014허4913 판결에서는 암 치료 의약용도발명의 진보성 판단기준으로 성공에 대한 합리적 기대 기준을 제시하였다. 본 논문에서는 대상판결이 제시한 성공에 대한 합리적 기대 기준을 우리나라 진보성 판단 시 도입하는 것이 필요한지에 대하여 연구하고자 한다. 본 연구는 다음과 같이 진행하였다.
1) 대상판결에 제시한 성공에 대한 합리적 기대 기준 검토
2) 우리나라와 미국에서의 진보성 판단방법에서 성공에 대한 합리적 기대 기준 확인
3) 상기 성공에 대한 합리적 기대 기준의 실질적 의미 확인
4) 우리나라에서 성공에 대한 합리적 기대 기준을 도입하는 것에 대한 필요성 검토
연구결과, 성공에 대한 합리적 기대 기준의 실질적 의미는 사후적 고찰을 막기 위하여, 진보성 판단 시 결합의 곤란성을 고려하여 판단하는 것으로 보인다. 이러한 실질적 의미 차원에서 본다면 우리나라에서 이미 사후적 고찰을 막기 위한 결합의 곤란성 관점에서 진보성을 판단하고 있기 때문에 성공에 대한 합리적 기대 기준의 도입은 필요하지 않다고 본다.
