In the age of the Fourth Industrial Revolution, the importance of software is expected to be higher than in the past. Therefore, it is expected that discussions about how to protect software with patents will become more active. In 2014, the Supreme Court of the United States adopted a somewhat stricter two-step test in determining a patent eligibility of a software, and there was some concern that this would lead to a software patent downturn. Recently, however, the United States Court of Appeals for the Federal Circuit (CAFC) has decided several cases to affirm the patent eligibility of the software, and the United States Patent and Trademark Office (USPTO) is actively using the several cases in patent examination. Therefore, in this study, I analyze judgment of the CAFC regarding the patent eligibility of software after Alice, and the handling of the patent eligibility of software in Korea at present. Finally, I would like to suggest a new criteria, based on analyzing, for judging the patent eligibility of software in Korea.
4차 산업혁명 시대에서, 소프트웨어의 중요성은 과거에 비해 더 높아질 것으로 예측된다. 따라서, 소프트웨어를 특허로 어떻게 보호할 것인지에 대한 논의도 더욱 활발해질 것으로 예상된다. 2014년 미국 연방대법원은 소프트웨어 발명의 성립성을 판단함에 있어 다소 엄격한 2 단계의 기준을 적용하였고, 이로 인해 소프트웨어 특허의 침체기가 도래할 것이라는 일각의 예상이 있었다. 하지만, 최근 미국 연방순회항소법원은 소프트웨어의 특허 적격성을 긍정하는 몇몇의 판례들은 선고하였고, 미국 특허청은 이것을 심사에 적극 활용하고 있다. 따라서, 본 연구에서는 Alice 판결 이후 소프트웨어의 특허 적격성에 대한 연방순회항소법원의 판결을 분석하고, 현재 우리나라에서 소프트웨어 발명의 성립성에 대한 취급을 검토한다. 이를 기반으로, 우리나라에서 소프트웨어 발명의 성립성에 대한 새로운 판단 기준을 제안하고자 한다.
