The world today is called 'the era of the fourth industrial revolution' and has brought about a great change in industry and our daily lives. With the advent of the fourth industrial revolution, Artificial Intelligence (A.I.), autonomous vehicles, Big data, and cloud computing, artificial intelligence robots are expected to have a great impact on our society. It is true that there is anticipation and fear due to the emergence of robot equipped with artificial intelligence that emerged with the development of ICT technology which is rapidly developing. It was inspired personally by watching the popular drama "Humans" which was aired in the UK in 2015, and gave me a chance to deeply think about future problems that may arise in the future.
In the era of the Fourth Industrial Revolution, robots, in particular, industries and services that had been confined to industrial robots in the past, have come to the point where intelligent robots are replacing people (roles) as well as our lives all over the world. Even advanced researchers are actively pursuing research that allows battle robots to carry out war on behalf of human beings. Therefore, there is a need for in-depth discussion about what side effects may occur and how to dispose of them if there are problems. That is, we defined the right concept of robot ethics and robot norms.
In the case of developed countries such as Europe, USA, and Japan, the appearance of robots across all industries is already a major trend, and efforts are being made to analyze rapid responses and social ripple effects. In Korea, however, technology related to the Fourth Industrial Revolution is quiteadvanced, but there is a lack of legal system support for it. Therefore, this study suggests that there are implications in that it can be suggested as a reasonable alternative to the legal institutional settlement of the robot related norms.
In addition, the introduction of the robot in general, as well as legal aspects related to the intelligent robot, for example, the issue of the legal entity of the robot, discussion on the introduction of the robot, various algorithms, such as the problem of algorithm bias or distortion of the software, Related issues. This study also explored the legal and regulatory measures that are reasonable and effective and suggested solutions for them.
요즘 세상은 ‘4차 산업혁명의 시대’라 말하며, 산업 전반과 우리의 실생활에 커다란 변화를 가져다주었다. 즉 4차 산업혁명의 도래와 함께 인공지능(AI), 무인자율주행차, 빅데이터, 클라우드 컴퓨팅 등과 더불어 인공지능 로봇은 우리사회에 커다란 변화와 영향을 줄 것으로 예상된다. 급속도로 발전하고 있는 ICT기술의 발전과 함께 등장한 인공지능을 장착한 로봇의 등장에 따른 기대감과 두려움이 상존하고 있는 것이 사실이다. 특히 2015년 영국에서 방영된 인기 드라마 을 보고 개인적으로 영감을 받기도 하였고, 또 앞으로 발생할지 모르는 미래의 문제점에 대한 깊은 사유를 하게 된 계기를 마련해 주었다.
4차 산업혁명의 시대를 맞아 특히 로봇은 과거 산업용 로봇에 국한되었던 산업 및 서비스가 이제는 우리의 생활전반 뿐만 아니라 인간(역할)을 대신하는 지능형 로봇이 등장하는 데까지 이르렀다. 심지어는 전투로봇이 인간을 대신하여 전쟁을 수행할 수 있도록 하는 연구가 선진국을 중심으로 활발히 진행되고 있다. 이에 따라서 발생할 수 있는 부작용은 무엇인지, 그리고 문제점이 있다면 이를 어떤 방식으로 어떻게 규율하여야 하는지에 대한 심도있는 고민이 요청된다. 즉 로봇윤리와 로봇규범에 대한 올바른 개념을 정의하였다.
그리고 지금 유럽을 비롯한 미국, 일본 등 선진국의 경우 전 산업에 걸쳐 로봇의 등장은 이미 대세적인 흐름이며 이에 따른 발빠른 대응과 사회적 파급효를 분석하는데 노력 중이다. 그러나 우리나라의 경우 4차 산업혁명 관련 기술은 상당히 앞서 있으나, 이에 대한 법제도적 뒷받침은 부족한 실정이다. 따라서 본 연구는 로봇관련 규범이 법제도적으로 정착하는 데에 합리적인 대안의 하나로 제시될 수 있다는 점에서 시사점이 있다고 생각한다.
또한 논문에서 로봇 전반에 대한 소개와 함께 지능형 로봇과 관련한 법적 관점, 예를 들면 로봇의 법인격 부여의 문제, 로봇세 도입 관련 논의, 인공지능 로봇의 브레인격인 소프트웨어의 알고리즘 편향 또는 왜곡의 문제점 등 다양한 각도에서 관련 문제점을 검토하였다. 이를 통해 합리적이고 효율적인 법적 규제방안이 무엇인지에 관하여도 연구하여 이에 대한 해결책을 제시하였다.
