The authors of literary, music, and audiovisual works are expected to expect economic benefits from their work by spreading the inherent value of the work and relatively easily through reproduction and distribution of the work. On the other hand, the authors of visual art are difficult to expect the wide expansion of the value of the works through reproduction of works.
This study summarizes the historical and judicial analysis of Droit de Suite(resale right), and examined the cases of foreign countries introducing the rights in connection with the situation of the art market in each country. Based on the review of overseas cases, the economic situation of Korean authors and the situation of domestic art market have been reviewed, and the validity and necessity of introducing the Droit de Suite(resale right) are examined. This study also conducted interviews with legal experts, art dealer, authors, and businessmen who have expertise and experience in the field of copyright to examine the perception of Droit de Suite(resale right).
어문, 음악, 영상저작물의 저작자들은 저작물에 대한 대량 복제와 배포를 통해 저작물이 내재한 가치를 확산시키고 비교적 용이하게 저작물을 통한 경제적 이익 창출을 기대할 수 있다. 복제를 통한 저작물 가치의 확장을 기대하기 어려운 미술저작물의 저작자들은 다른 저작자들과 비교했을 때 저작재산권을 행사할 기회가 제한되어 있다.
본 연구는 추급권에 대한 역사적, 법리적 분석을 요약하고, 추급권을 도입하여 운영하고 있는 해외의 사례를 각국 미술시장의 상황과 연계하여 살펴보았다. 해외 사례에 대한 검토를 기초로 국내 미술저작자들이 처해 있는 경제적으로 열악한 상황과 국내 미술시장의 상황을 살펴보면서 추급권 도입의 타당성과 필요성에 대해 검토했다. 이를 바탕으로 본 연구는 저작권 분야의 전문 지식과 경험을 가진 법관, 변호사, 전문중개인, 미술작가, 일반 기업인들을 대상으로 전문가 인터뷰를 실시하여 추급권 제도에 대한 인식을 살펴보고, 제도 도입을 위한 구체적인 방안을 수렴하고자 하였다.
