Today, almost each and everything around us are tightly coupled with software. When John W. Tukey first talked about the concept of software in 1957, people thought that software was a subordinate to hard-ware, a physical device. However, through the rapidly changing business environment and the advancement of computer technology, software has been recognized as an independent object and its value and im-portance are higher than ever before, even beyond the status of hardware. Moreover, the software will play a pivotal role in streamlining the operational excellence of the company in the fourth industrial revolution.
However, in the history of software close to 60 years, disputes and conflicts over software licenses have been constantly occurring and are continuing at this moment. Particularly, disputes over the use of enter-prise software cause very high social costs, but it is difficult to find a fundamental solution because the in-volved parties have the nature to hide or reduce facts. The purpose of this study is to investigate the causes of enterprise software disputes through related previous researches and expert groups discussion, and then to verify the findings with in - depth interviews with the people in the field. Research has demonstrated that usage-based software contracts can reduce disputes over enterprise software in response to changes in soft-ware usage patterns today. At the same time, proposed a simplification of the contract to reduce the complexity and information asymmetry of traditional software licensing.
오늘날 우리를 둘러싼 모든 요소에는 소프트웨어가 밀접하게 결합되어 있다. 1957년에 존 터키(John W. Tukey)가 처음 소프트웨어라는 개념을 이야기했을 때만 해도 사람들은 소프트웨어란 물리적인 장치인 하드웨어에 종속된 대상으로 생각했다. 하지만 점점 더 빠르게 변모하는 경영 환경과 컴퓨터 공학 발전을 통해서 소프트웨어는 독립된 가치를 인정받았고 어느 순간 하드웨어의 지위를 넘어서 과거 어느 때보다 그 역할과 중요성이 높은 상태이다. 또한 앞으로도 4차 산업 혁명의 물결 속에서 소프트웨어는 기업의 운영 효율화에 더욱 중추적인 역할을 할 것으로 예상한다.
하지만 60여년이라는 반세기가 넘는 소프트웨어의 역사 속에서 소프트웨어 사용권에 대한 분쟁과 갈등은 끊임없이 발생해왔고 지금 이 순간에도 계속되고 있다. 특히 기업용 소프트웨어 초과 사용에 대한 분쟁은 매우 큰 사회적 비용을 발생시키고 있지만, 당사자들이 사실 관계를 숨기거나 축소하고 싶어하는 성격을 갖고 있기때문에 근본적인 해결책 모색이 어려운 실정이다. 이에 본 연구는 분쟁 발생의 원인을 선행연구와 전문가 집단과의 토의를 통해서 도출한 뒤, 도출된 연구 주제를 실제 업무에 종사하는 담당자들과 심층 인터뷰로 검증하고 해결방안을 제시하고자 하였다.
연구를 통해서 오늘날 소프트웨어 사용 패턴의 변화에 맞춰서 사용량 기반의 소프트웨어 계약이 기업용 소프트웨어를 둘러싼 분쟁을 줄일 수 있다는 점을 검증하였다. 동시에 기존의 소프트웨어 라이선스 방식이 갖고 있는 복잡성과 정보 비대칭을 감소시킬 수 있는 방안으로 계약의 단순화 방안을 제시했다.
