The most conspicuous aspect of online trademark infringement is counterfeiting, and regulations against the distribution of counterfeit goods through such Information and Communications Service Provider as stand-alone sites, online marketplaces, portals, and SNS have encountered a number of limitations and problems in terms of legal system, technology, and practicality, whether it be administrative regulation or so-called temporary measure such as notice and take-down procedure. Therefore, this study aims to search for ways to put more enhanced and robust regulatory system in place designed to police illicit practices of selling counterfeit goods online.
최근 인터넷 기술의 발달 및 스마트폰의 보급화로 개인쇼핑몰, 오픈마켓, 블로그, SNS 등 다양한 정보통신서비스 제공자를 통한 온라인 상표권침해, 그 중에서도 대표적으로 위조상품 유통문제가 기승을 부리고 있어 정부부처, 공공기관, 상표권자 등 이해관계자가 정보통신망 이용촉진 및 정보보호 등에 관한 법률에 따라 적극적인 규제 노력을 펼치고는 있으나 법률, 기술, 운영 등 다양한 측면에서 점차 그 한계점을 마주하고 있는 실정이다. 따라서 본 논문에서는 정보통신서비스 제공자 규제의 유형별 문제점을 파악하고 해외법률 및 제도와의 비교법적 분석을 통해 전통적인 위조상품 유통정보 규제체계에서 새로운 규제 패러다임으로의 변화를 이끌어냄으로써 국내 정보통신서비스 제공자 규제개선을 위한 구체적인 방향성을 제시하고자 한다.
