Patent protection serves as a powerful tool for preventing imitation of technologies from rivals. For that reason, firms establish several strategies to protect their patents when they apply them. However, backward citation and patent family size have not been considered in previous studies while they are important patent protection strategies for firms. In this paper, we examine how backward citation and patent family size can inhibit patent invalidation suits and be used as strategies to defend patents around the world. Especially, we examine the effects of these patent protection strategies on firms’ mar-ket value focusing on the renewable energy sector in South Korea. We find that these two patent protec-tion strategies have significant effects on firms’ market values proving that they are important tools in protecting patents. In addition, our findings suggest that protecting firms’ own intellectual property is an important factor for improving their market values, especially, in the renewable energy industry.
신 재생 에너지와 같은 high-technology industry의 경우에 기술적 자원이 지니는 가치가 매우 크게 된다. 이 전의 연구에 따르면, 신 재생 에너지 분야 안에서 기술적 자원이 회사의 성과에 미치는 영향에 대해서는 연구가 많이 이루어 졌지만, 이 기술을 보호하고 방어하는 전략이 회사의 가치에 미치는 영향에 대한 연구는 부족하였다. 본 연구는 이 점에 착안하여 연구를 시작하였고, 회사의 특허가 가지는 가치뿐만 아니라, 그 특허를 보호하는 정도를 측정하여 회사의 시장가치에 미치는 영향을 분석해 보았다. 본 연구에서는 특허를 보호하는 정도를 backward citation과 family patent size로 측정하였다. Backward citation의 경우 특허의 인용 정도가 많으면 많을수록 특허를 특허 무효소송으로부터 방어할 수 있는 정도가 높아지며, family patent size의 경우 자신의 특허를 타 국가에도 출원을 해 동시에 여러 국가에 자신의 기술을 보호할 수 있는 하나의 전략이다. 본 연구는 실증적인 분석을 위해 Hall et al(2005)년 모델을 변형하여 회사의 시장가치에 특허의 특성이 주는 정도를 측정하였고, 연구 결과 특허의 보호 정도가 크면 클수록 신 재생에너지 분야 아래에서는 시장 가치에 유의하게 긍정적인 영향을 미치는 것으로 나타났다.
