Future products in the field of emerging technology have lots of technical problems to be solved to be mean-ingfully introduced into the near future market with reliable performances. In this situation, this study is initiated with the expectation of making strong conceptual patent by applying future forecast techniques to estimate technical problems of future products and by solving those problems and by using those solutions to develop conceptual patent. Firstly, future forecast is determined as an appropriate tool to be used for enhancing 3 elements, product relevancy, patent validity and market influence which are all required to lender conceptual patent strong. And based on this determination, as a methodology for developing strong conceptual patent, 5 scenario analysis steps and 3 strategic patent prosecution steps are suggested. 5 scenario analysis steps is performed before the filing the patent application and comprises target theme selection, related elements collection, scenario composition, estimated problems extraction and inventive element drawing, through these 5 steps, several inventive elements which could be implemented into the future prod-ucts with high possibility, are drawn. Especially, as case study, 5 scenario analysis steps were applied into the Drone Delivery Systems to draw several inventive elements. 3 strategic patent prosecution steps are performed during the patent prosecution and comprise composition inventive elements tree, target product encompassment and portfolio deployment, through these 3 steps, contributed to render strong conceptual patent to be issued.
유망기술분야의 미래제품은 가까운 미래에 신뢰성 있는 성능으로 시장에 본격적으로 출시되기 위해서 해결해야 될 많은 기술적 문제를 갖고 있다. 이러한 상황에서 미래예측 기법을 활용하여 미래제품에서 예상되는 기술적 문제를 미리 예측하고, 이에 대한 해결책을 도출하고, 이를 이용하여 특허출원을 한다면 활용도가 높은 개념특허를 얻을 수 있겠다고 기대하여 본 연구를 시작하였다. 우선 특허활용도 제고를 위해 필요한 3요소 즉, 제품관련성, 특허유효성 및 시장영향도의 검토를 통해 개념특허 개발에 있어 미래예측의 중요성을 확인하게 되었다. 이를 토대로 미래예측을 통한 개념특허 개발방법론으로 시나리오 분석 5단계 및 전략적 특허출원 3단계를 제안하였다. 시나리오 분석 5단계는 출원 전 수행되는 절차로서 목표주제 선정, 관련요소 수집, 시나리오 구성, 예상문제 추출 및 발명요소 도출 단계로 구성되며 5단계를 통해 향후 출시될 제품에 구현될 가능성이 높은 다양한 발명요소를 도출하게 된다. 특히, 드론배송시스템을 사례로 하여 시나리오분석 5단계를 적용하여 발명요소를 도출하는 과정을 연구하였다. 전략적 특허출원 3단계는 출원진행과정에서의 수행되는 절차로서 발명요소 트리(Tree) 구성, 목표제품 포섭 및 포트폴리오 전개의 3단계로 구성되며 활용도 높은 개념특허의 등록되도록 기여하게 된다.
