This research thesis re-examines copyright infringement cases following development of IT technology, focusing on webhards practices and TV PAD (set-top box), and countermeasure solutions for dealing with such infringement. Webhards are mainly classified into two types: bulletin boards and clubs, and this thesis will discuss practical problems involving technological circumvention methods for each type. The Korean Supreme Court views that the webhard operators who infringe copyright are the aiding and abetting offenders and not the main offender, as they do not personally duplicate nor upload copyright files. However, there are cases where the operators are personally involved in the act of infringement and should be considered as the main offender. In addition to discussing case studies on copyright infringement presented in the Courts, this thesis shall explore practical cases and loopholes where webhard operators continue to commit offence in other ways including failing to pay to the copyright owners. Due to these recurring offences and illegal practices, distrust between webhard operators and copyright owner has grown deeper. This thesis discusses the current measurement adopted by copyright owners against copyright infringements and their inherent limits and problems. Also, this paper proposes new solutions to provide practical protection for copyright owners as well as ways for how good webhard operators may earn trust and effective countermeasures for those abusing the system. In addition, this thesis will examine closely at the case of set-top box device called TV PAD, which connects TV to various media contents including TV channels and films without additional cost, and thereby causing copyright infringements. Examination of technical operation of set-top box, how its operation causes copyright infringement and the countermeasure solutions will be discussed in this thesis.
본 연구는 IT 기술발전에 따른 저작권 침해 사례 중 침해 단속 실무상 문제된 웹하드 사업자 및 TV PAD 셋톱박스로 인한 저작권 침해 사례를 살펴보고 이러한 침해에 대한 대응방안을 제시한다. 웹하드는 게시판형과 클럽형의 방식으로 구분할 수도 있는데, 각 형태에 따른 기술적조치 우회에 관한 문제 등 실무상 발생되는 문제점을 살펴본다. 웹하드 사업자의 경우 우리 대법원 판결에 따르면 저작물 파일을 직접 복제, 전송하는 행위를 하지 않기 때문에 저작권법위반의 정범이 아닌 방조범으로 처벌되는데, 겉으로는 이용자들이 저작물 파일을 업로드 하는 것처럼 보이지만 실제로는 웹하드 사업자가 직접 파일을 업로드 하는 경우도 있기 때문에 정범으로 처벌해야 하는 경우도 있다. 한편, 저작권법위반 문제뿐만 아니라 저작권자에게 지급해야 할 정산금을 누락시키는 방법으로 저작권자를 속이는 사기범죄 등 실무상 경험한 웹하드 사업자의 불법행위의 실태를 살펴본다. 또한 이러한 범죄로 인하여 웹하드 사업자와 저작권자 사이에는 깊은 불신이 자리잡게 되었는데 저작권자가 현재까지 선택한 저작권 침해행위에 대한 대응 및 문제점을 살피고, 향후 저작권자를 실질적으로 보호하면서 웹하드 사업자의 신뢰를 회복할 수 있는 방안 및 제도를 악용하는 자에 대하여 어떠한 조치를 취하는 것이 효과적인지에 대한 방안을 제시한다. 그리고 최근에는 TV PAD라는 명칭의 셋톱박스를 판매하고 이를 구입하면 추가 비용 없이 방송, 영화 등 많은 콘텐츠를 무제한 시청할 수 있도록 하는 유형의 저작권 침해사례가 발생하였는데, 이에 대하여도 해당 셋톱박스가 어떻게 작동하는지에 대한 기술적 설명과 각 작동행위가 어떻게 저작권을 침해하는 것인지에 대하여도 살피고, 이러한 침해행위에 대한 대응방안에 대하여 논의하기로 한다.
