Korea Approval-Patent Linkage System will be implemented in March 2015 by being introduced Hatch-Waxman Act of the US. The Approval-Patent Linkage System is a system to achieve the balance between the right of access to the drugs of generic pharmaceutical companies and the exclusive right of the original pharmaceutical companies. Reverse-payment Settlement have been the agreement to delay the market entry of generic drugs in exchange for monetary compensation by the original and generic companies.
In this study, we introduce the main issue of the Approval-Patent Linkage System and judicial precedents connected with Reverse-payment settlement. Then, we analyze the differences in pharmaceutical market size, R&D investment, drug pricing, patent system and the logic of rights abuse in the US and Korea in order to verify the feasibility of the introduction of the system.
We have identified several issues that arise from generic exclusivity of Approval-Patent Linkage System through expert’s interviews. We propose the two legislation amendments to prevent unsuitable reverse-payment settlements. First, the generic exclusivity period needs to be cut a similar level of the US. Second, if the reverse-payment settlements have been confirmed as being unlawful, it is necessary to allow the claims for punitive damages to each company.
This article focus on the legislative policy of the Approval-Patent Linkage System for reducing Reverse-payment settlement; and tries to contribute the system to be established successfully in Korea.
미국의 Hatch-Waxman 법의 국내 도입으로 2015년 3월부터 우리나라 허가-특허 연계제도가 본격적으로 시행된다. 허가-특허 연계제도는 오리지널 사의 권리와 제네릭 사의 오리지널 의약품에 대한 접근권 사이의 균형을 이룰 수 있도록 하는 제도이다. 1984년 Hatch-Waxman 법이 시행된 후 예상하지 못한 많은 문제들이 발생하였고 오리지널 사와 제네릭 사 사이의 제네릭 의약품에 대한 시장 진입을 지연하는 것을 조건으로 보상하는 역지불 합의가 큰 문제가 되었다.
본 논문에서는 역지불 합의와 관련하여 미국의 Hatch-Waxman 법과 우리나라의 허가-특허 연계제도의 주요 내용 및 양국의 역지불 합의와 관련된 판례 사안을 검토하였다. 이를 토대로 제약시장, R&D, 제네릭 의약품의 약가 결정 정책, 오리지널 의약품과의 약가 비교, 특허 제도 및 권리남용에 대한 법적 논리에 대한 차이점을 분석하여 허가-특허 연계제도를 현재 그대로 도입하는 것이 타당한지 판단하였다.
전문가 심층 인터뷰를 통해 허가-특허 연계제도에서 제네릭 독점권으로부터 발생할 수 있는 문제점을 확인하였고 역지불 합의로 소비자에게 피해가 미칠 것을 감안하여 i) 제네릭 독점권의 기간을 축소시키는 규정 및 ii) 역지불 합의가 인정되는 경우에 징벌적 손해 배상을 도입하는 등의 역지불 합의 방지를 위한 입법을 제안하였다.
본 연구가 향후의 입법 정책 판단에 기여하여 허가-특허 연계제도가 성공적으로 정착할 수 있으리라 판단한다.
