Under the Korean patent law, studies about ‘PHOSITA’ were limited to suggestion for accumulation of circumstantial evidence and improvement for both trial hearing process and judgment with consideration of whether the skill level of PHOSITA could be the standard to decide non-obviousness and the written require-ments among the patent specification. Only a few studies covered the tools for deducting the skill level of PHOSITA and analyzing the meaning of ‘ordinary’ specifically. In this study, the skill level of PHOSITA de-fined as an ‘average’ skill level by comparing the notion of ‘PHOSITA’ and the relationship between skill level of the PHOSITA and the scope of the knowledge, not only based on guidelines and examination standards of ‘PHOSITA’ in each countries, but also case study of Korean patent court and the Supreme court. Further-more, in order to sort the skilled person with the ‘average’ skill level, this research focused on the meaning of ‘average’ that premised the parent population. Therefore, each of inventions can be classified into the several levels with setting the number of patent invention in the corresponding field as a parent population. And then, designating an average skill level in that field as a value derived from the total number of inventions in the corresponding field divided by the sum of the level of each inventions. This study suggested this methodology for specifying inventions in accordance with the ‘average’ skill level that can be also applied to sorting the pool of the ‘average’ skilled person. Furthermore, this study suggested two different implications of the ‘ordi-nary’ for ‘PHOSITA’ that covered not only the average skill level already possessed, but also the ability of acquiring new skills having one-to-one relation with the scope of knowledge acquisition. In this study, I sug-gested that the objective methodology for clarifying one of the most blur notion under patent law, ‘PHOSITA’. These results may lead to Korea as an IP hub country by vitalizing IP related industries such as classifications in technical fields and in the level of inventions, analysis, research and evaluation as well as supporting reliable and objective decisions of the courts with formation of convincing and objective pool of technical specialists.
기존의 특허법상 ‘통상의 기술자’에 대한 연구는 통상의 기술자의 기술수준이 진보성과 명세서 기재요건 판단에 있어 동일한 것인지 여부에 대한 논의와 통상의 기술자의 기술수준이 요증사실이라는 점에 착안하여 이를 입증할 간접사실 목록을 축적하고 특허소송의 심리방식 및 판결을 개선해야 한다는 논의에 국한이 되었으며, 통상의 기술자의 기술수준을 객관적으로 도출할 수 있는 방법 및 ‘통상’의 의미에 대한 구체적인 분석에 관한 연구는 부족하였다. 본 연구에서는 통상의 기술자에 대한 각국의 규정 및 심사기준, 국내 특허법원, 대법원 판례, 선행연구들을 통해 통상의 기술자의 개념과 그 기술수준과 지식범위의 관계를 비교, 분석하여 통상의 기술자의 기술수준을 ‘평균적’인 수준으로 파악하고, 이러한 ‘평균적’ 기술수준에 해당하는 기술자들을 도출하기 위하여, ‘평균’이 모 집단을 전제로 한 확률 개념이라는 점에 주목하여, 당해 기술분야의 공지된 발명들의 수를 모집단으로 하여, 해당 기술분야의 각 발명을 몇 단계의 수준으로 분류하여 각 발명의 수준 값의 합을 당해 기술분야의 전체 발명의 숫자로 나눈 값을 당해 기술분야의 평균적 기술수준 값으로 특정을 한 후, 이에 해당하는 발명들을 특정하는 방법론을 제시함으로써 ‘평균적’ 기술자 POOL을 선정할 수 있도록 하였다. 또한 통상의 기술자의 ‘통상’의 의미는 통상의 기술자가 ‘보유’하고 있는 기술수준이 ‘평균적’이라는 의미 외에 지식범위 획득과 기술수준 습득이 1 대 1 비례관계에 있는 ‘기술습득능력’으로서의 ‘통상’이라는 함의를 가지고 있음을 밝혔다. 본 연구결과를 통해, 특허법상의 대표적인 불확정 개념인 통상의 기술자를 객관적으로 도출할 수 있는 방법과 논거를 제시함으로써, 특허심사 및 소송에서 신뢰성 있고 객관적인 기술전문가 POOL의 구성을 가능하게 하고, 이를 통하여 기술분야 분류, 발명 수준 분류, 분석, 리서치, 감정 등 IP 관련 산업을 활성화하게 하고, 법원의 판단에 신뢰성과 객관성을 부여함으로써 우리나라가 특허 IP 허브 국가로서의 경쟁력을 갖추게 하는 데 기여할 수 있다고 할 것이다.
