In recent years, various discussions and previous studies on whether architectural works are eligible for protection under the Copyright Act, the classification of works according to the creativity of buildings, and research related to infringement of architectural copyrights. Due to the entry into force of the Bern Convention and the comprehensive revision of the Copyright Act, buildings are considered works under the Copyright Act and there are protection provisions for copyright property rights and moral rights, but the reality is that there is a lack of awareness among creators and the public regarding copyright in buildings, and that buildings are a single product and a single production. Due to the nature of the work being installed and installed on the ground on a limited and specific site, there does not seem to have been active discussion on ways to strengthen architectural copyright protection. We aim to study ways to strengthen building copyright protection by converging Digital Twin Technologies(Metaverse and BIM), the application of which is being actively discussed in various fields due to technological advancement.
건축저작물에 대한 저작권법상 보호 대상 여부 및 건축물의 창작성에 따른 저작물 분류, 건축물저작권의 침해와 관련된 연구에 대해서는 다양한 논의와 선행연구 사례가 있는 것으로 확인된다. 베른협약 발효 및 저작권법의 전면개정으로 인하여 건축물도 저작권법 상 저작물로 보아 저작재산권과 저작인격권에 대한 보호 규정은 있지만, 건축물저작권에 대한 창작자와 대중의 인식이 부족한 현실이며, 건축물이 단일 제품, 단일 생산되는 작품으로서 제한되고 특정된 대지의 지상에 정착 및 설치되어 공개되는 특성 때문에 그동안 건축물저작권 보호 강화 방안에 대해서는 활발한 논의가 이루어지지 않은 것으로 보인다. 기술의 발전으로 다양한 분야의 적용이 활발히 논의되고 있는 디지털트윈 기술 증 메타버스와 BIM 기술을 융합・활용하여 건축물저작권 보호 강화 방안을 연구하고자 한다.
