The general clause of act of unfair competition have been used very actively in practice since their introduction in 2013. The general clause of act of unfair competition has the potential to be broadly applied to intellectual property-related disputes due to the abstract nature of the clause. Accordingly, discussions on the need to limit the scope of application of the general clause, considering the relationship with other intellectual property systems, have continued since the introduction of the regulations. In March 2020, the Supreme Court presented the legal principle that if economic interests infringed upon by unauthorized use of outcomes, etc. belong to the public domain that can be freely used by anyone, acts of unfair competition under the general clause do not occur. However, it is still unclear which specific cases fall into the public domain, so confusion in practice is expected. Accordingly, by examining the meaning of the public domain, this paper seeks to distinguish between cases where the general provisions on unfair competition practices can be applied and cases where they cannot.
부정경쟁행위 일반조항은 2013년 도입된 이후 실무상 매우 활발하게 이용되어 왔다. 부정경쟁행위 일반조항은 그 규정내용의 추상성으로 인하여 지식재산 관련 분쟁에 광범위하게 적용될 여지를 내포하고 있다. 이에 다른 지식재산제도와의 관계를 고려하여 부정경쟁행위 일반조항의 적용범위를 제한하여야 한다는 논의가 규정 도입 당시부터 계속되었다. 대법원은 2020년 3월 성과 등을 무단으로 사용함으로써 침해된 경제적 이익이 누구나 자유롭게 이용할 수 있는 공공영역(public domain)에 속하는 경우에는 일반조항에 따른 부정경쟁행위가 성립하지 않는다는 법리를 제시하였다. 그러나 구체적으로 어떤 경우가 공공영역에 속하는지는 여전히 불분명하여 실무상 혼란이 예상된다. 이에 이 논문은 공공영역의 의미를 고찰함으로써 부정경쟁행위 일반조항을 적용할 수 있는 경우와 그렇지 않은 경우를 구분하여 제시해 보고자 한다.
