Due to the recent competition between the U.S. and China's technological hegemony, soaring prices of key raw materials and unstable supply and demand in the aftermath of the COVID-19 pandemic and the Russia-Ukraine War, countries around the world are implementing extended protectionist policies such as economic bloc or strengthening economic security between countries. In particular, the establishment and implementation of the Economic Security Act in Japan gives many implications to this international situation. Korea has traditionally entered the group of advanced countries, pursuing global market preoccupation and industrial development through compliance with WTO/TRIPs agreement obligations and patent multi-application. However, Korea has problems such as a decrease in market share in national core technology-related industries, a narrowing of the science and technology gap with “technological catching-up players,” and an increase in the number of leakage of national core technologies. This paper suggested the direction of revision of the patent system to prevent the leakage of national core technologies and National High-Tech Strategic Technologies, and directions to amend the patent system to strengthen economic security, and the direction of the reasonable compensation system to minimize the loss of inventors or applicants that may occur due to the introduction of a secret patent system with an expanded scope of restrictions.
최근 미·중 기술패권의 경쟁 구도와 코로나 팬데믹, 러·우 전쟁 등의 여파로 인한 핵심 원자재 가격 급등 및 수급 불안정으로 인하여 세계 각국은 국가간 경제블록화 또는 경제안보 강화 등의 확장된 보호주의 정책을 시행 중이다. 특히 일본의 경제안전보장추진법 설립 및 시행 행보는 이러한 국제정세에 많은 시사점을 부여한다. 한국은 전통적으로 TRIPs 협정 의무 준수와 특허 다출원을 통한 글로벌시장 선점 및 산업발전을 추구하며 선진국 그룹으로 진입하였으나, 최근 국가핵심기술 분야의 시장 점유율 감소, 기술 추격국과의 기술격차 축소, 해외로의 기술유출 증가 등의 문제들로 인해 제도적 방안의 필요성이 강조되고 있다. 본 논문은 국가핵심기술 및 국가첨단기술의 기술 유출 방지를 위한 특허제도의 개정안과 경제안보 강화를 위한 특허제도의 개정방향을 제안하였으며, 제한대상의 범위가 확대된 비밀특허제도를 도입으로 인해 발생 가능한 발명자 또는 출원인의 손실을 최소화하기 위한 합리적인 비밀특허 보상제도의 방향을 제안하였다.
