According to the World Intellectual Property Organization (WIPO), there are five regional inter-state patent organizations globally: the EPO & UPC, ARIPO, OAPI, GCCPO and EAPO. This paper examines the deriving factors of each organization from a comparative law perspective and examines the characteristics of each organization by categorizing patent practice and litigation stages. Based on the analysis, the purpose of this research is to devise means for inter-Korean patent cooperation and (North) East Asia patent harmonization. First, this paper analyzes the DPRK invention & patent system through a literature review and examines it’s actual practice and technological trends through technical analysis based on the International Patent Classification (IPC) listed in the DPRK Official Journal of Invention to derive measures for inter-Korean patent cooperation. Second, this research seeks means for East Asian patent harmonization, which has been evolving in terms of both the patent policy and trade agreements.
세계지식재산권기구(WIPO)에 따르면 세계적으로 EPO & UPC, ARIPO, OAPI, GCCPO와 EAPO 총 5개 역내 국가 간 특허기구가 있다. 이 논문은 비교법의 관점에서 각 기구의 파생요인을 살펴보고 특허실무 및 소송 단계를 구분하여 기구 별 특징을 살펴본다. 이를 바탕으로 남북 특허협력 및 동아시아 특허 통일화 방안을 모색한다. 우선, 문헌분석을 통해 북한 발명·특허제도를 분석 및 발명공보에 등재된 국제특허분류(IPC)를 기준으로 한 기술분석을 통해 북한 발명·특허제도의 실제운용 및 기술동향을 살펴보고 남북 특허협력 방안을 도출한다. 둘째, 지금까지 특허제도와 무역협정의 각각의 측면에서 발전해온 동(북)아시아 특허제도 통일화 방안을 모색한다.
