In this study, we study the discussion on the suspension of patent rights in the context of an epidemic pandemic. In addition to the contents of the traditional compulsory license, we look at the discussions in the proposal for the suspension of the obligation to protect intellectual property rights for the suspension of patent rights submitted to the WTO due to the corona crisis, and in particular, the effect and details of the WTO agreement made on June 17, 2022 to explore the possibility of introducing legal principles for the effect of the suspension of patent rights and the impact it will have on Korea, and its expected form and impact.
본 연구에서는, 전염병 범유행 상황 하에서의 특허권 효력 유예에 대한 논의를 연구한다. 전통적인 강제실시권에 대한 내용 뿐 아니라, 코로나 사태로 인해 WTO에 제출된 특허권 유예에 대한 지재권 보호의무 유예 제안서에 나타난 논의에 대해 살피고, 특히 2022년 6월 17일에 이루어진 WTO 합의문에 대한 효력 및 세부 내용을 연구하여 대한민국에 미칠 영향 및 특허권 효력 유예에 대한 법리 도입의 가능성 및 그 예상 형태 및 영향에 대해 탐구한다.
