The second medical use invention, which protects the new efficacy of existing known substances by the invention, is becoming more important in the pharmaceutical industry, so it is very important to interpret the scope of rights. Meanwhile, the Korean Patent Act was partially revised in 2019 regarding the judgment of infringement of method inventions, and a new interpretation standard is needed. By interpreting foreign precedents and second medical use inventions as method inventions and analyzing U.S. precedents that admit induced infringement (especially the Carvedilol case), I will intend to interpret the scope of rights for the second medical use invention of our patent law and establish standards for determining infringement.
기존 공지물질에 대한 새로운 효능을 발명으로 보호하는 제2의약용도발명은 제약산업에서 중요성이 더욱 커지고 있어 그에 대한 권리범위 해석이 매우 중요하다. 한편 우리 특허법은 2019년에 방법발명의 침해 판단에 관하여 일부 개정하였으며 이에 대한 새로운 해석 기준이 필요하다. 제2의약용도발명에 관한 외국 판례 및 제2의약용도발명을 방법발명으로 해석하고 유도침해를 인정하는 미국 판례(특히, 카르베딜롤 사건)을 분석하여 우리 특허법의 제2의약용도발명에 관한 권리범위를 해석하고 침해 판단의 기준을 마련하고자 한다.
