The Korean government is expanding the revitalization of intellectual property financial investment, and accordingly, the importance of evaluating the value of intellectual property is increasing. Although most of the existing intellectual property valuation has been centered on patent rights, research on trademark and design rights is also needed to improve the reliability of value evaluation results by resolving blind spots and evaluating the value in consideration of the characteristics of each intellectual property. Currently, the industry is hot with the design war. In order for Korea's design industry to develop, it is necessary to revitalize design transactions by conducting fair value evaluation on design rights. Therefore, this study is a study on the valuation of design rights, and discussed ways to improve the existing Income approach model in consideration of the specificity of the domestic design system. In particular, it was intended to present in detail a method that can be applied to the valuation of design rights through the law on calculating damages for domestic and foreign design infringement.
정부는 지식재산 금융투자의 활성화를 확대 추진하고 있고, 이에 따라 지식재산의 가치평가에 대한 중요성이 커지고 있다. 기존의 지식재산 가치평가는 특허권을 중심으로 대부분 이루어져 왔으나, 상표권․디자인권 등에 대한 연구도 가치평가의 사각지대를 해소하고 각 지식재산권의 특성을 고려하여 가치를 평가함으로써 가치평가 결과의 신뢰성을 높이기 위한 연구가 필요하다. 현재 산업계는 디자인 전쟁으로 뜨겁다. 우리나라의 디자인 산업이 발전하기 위해서는 디자인권에 대한 공정가치평가가 이루어짐으로써 디자인 거래의 활성화가 필요하다. 이에 본 연구는 디자인권 가치평가에 대한 연구로서, 국내 디자인 제도의 특수성을 고려한 기존의 수익접근법 모델의 개선 방안에 대하여 논의하였다. 특히 국내외 디자인 침해에 관한 손해배상액 산정 법리를 활용하여 디자인권 가치평가에 적용할 수 있는 방법을 구체적으로 제시하고자 하였다.
