The medical use invention refers to an invention that provides a new use that exerts efficacy as a medicine based on the discovery of an unknown attribute of a specific pharmacological effect of a medicinal substance. In general, in order to satisfy patent eligibility under the Patent Act in medical use invention, it has the specificity of having to go through the steps of finding out the pharmacological mechanism that is the mechanism that causes the specific pharmacological effect of a certain medicinal substance to be exerted, and finding the medicinal use exerted by this pharmacological mechanism. In addition, in the case of a medical use invention, there is a lot of uncertain data, and in order to actually confirm the estimated efficacy, it is necessary to invest in a long-term experiment, and it also has a specificity that the risk of failure is large. Therefore, this thesis intends to study whether it can be used as a cited invention that denies patentability because it may lead to a conclusion that it is possible to discover a new drug effect through an incomplete invention that is not supported by experimental data.
의약용도발명은 의약물질이 가지는 특정의 약리효과라는 미지의 속성의 발견에 기초하여 의약으로서의 효능을 발휘하는 새로운 용도를 제공하는 발명을 의미한다. 일반적으로 의약용도발명에 있어서 특허법상 발명의 성립성 요건을 만족하려면 어떠한 의약물질의 특정 약리효과가 발휘되는 원인이 되는 메커니즘인 약리기전을 찾아내고, 이러한 약리기전에 의하여 발휘되는 의약적 용도를 찾아내는 단계를 거쳐야 하는 특수성을 가진다. 또한 의약용도발명의 경우에 불확실한 데이터가 많고, 추정되는 약효를 실제로 확인하기 위해서는 장기간의 실험에 따른 투자가 필요하며, 그 실패에 따른 리스크가 크다는 특수성도 지닌다. 따라서, 본 논문에서는 실험 데이터로 뒷받침되어 있지 않은 미완성발명을 통해 새로운 약효를 발견해 내는 것이 가능하다는 결론에 이를 수도 있다는 이유로 특허성을 부정하는 인용발명으로 사용할 수 있는지에 대해 연구하고자 한다.
