With the development of the Internet, the consumption of broadcast contents have diversified and OTT (Over the Top), which refers to a service that provides various media contents through the internet network, is becoming the center of consumption for broadcast and video contents. As the online contents consumption market expands, copyright-related research has become essential, such as collecting royalties for music inserted into the video contents on the OTT platform. This study aimed to compare the music copyright regulations for online video services in the US, EU and Korea by analyzing the legal systems governing music copyright permissions for online video contents in the US, EU and Korea. The study tried to detail the characteristics of each country and analyze how Korea should move forward. The study found that the US and EU define the subject right as a synchronization right, whereas Korea does not explicitly recognize it in its Copyright Act. Instead, Korea adopts the rights to prepare derivate works based on the copyrighted work. In addition, unlike most countries in the United States and EU, there are special rules for video material in Korea. If the rights are processed during video production, it is assumed that other types of rights, such as performances and broadcasts, have been licensed after production. It was confirmed that, unless there is a special agreement, there are regulations that allow users to use the music to promote its widespread use. Therefore, domestic contents providers familiar with the Korean legal system should obtain permission from the copyright holder for each type of music they want to use or comprehensively, considering that the regulations do not apply when using foreign music. As a result of the study, it was possible to deduce that it can prevent disputes related to copyright infringement.
인터넷의 발전에 따라 방송 콘텐츠의 소비가 다양화되고 이에 인터넷망을 통해 다양한 미디어 콘텐츠를 제공하는 서비스를 지칭하는 OTT(Over The Top)가 방송 및 비디오 콘텐츠 소비의 중심이 되어가고 있다. 이와 더불어 OTT 플랫폼의 비디오 콘텐츠에 삽입되는 음악 저작물의 사용료 징수 방식 등 법제 체계에 대한 연구가 산업에서 매우 중요한 이슈가 되었다. 이에 본 연구에서는 미국과 EU, 그리고 한국의 온라인 동영상 콘텐츠의 음악저작권 법제체계 분석을 통해 미국과 EU 그리고 한국의 온라인 동영상 서비스 음악저작권 규정의 비교분석을 진행하였다. 연구결과, 미국과 EU는 대상권리를 싱크권으로 보장하는데 반해 한국은 저작권법에서 싱크권을 명시적으로 인정하지 않고 있으며 대신 2차적저작물작성권으로 규정하고 있는 것을 알 수 있었다. 한국의 경우 미국이나 EU 대부분의 국가와는 달리 영상물특례규정을 두고 있어 별도의 특약이 없는 한 이용자들이 용이하게 저작물을 이용할 수 있는 규정이 있기 때문에 저작물의 이용 활성화를 도모하고 있음을 확인할 수 있었다. 이에 국내 콘텐츠제작사들이 국내외 음악을 영상물에 사용하고자 할 경우에 각 국가별 저작물 이용방식에 대한 특징을 파악하여 정확한 전략을 수립해야 할 것이다.
