In the case of trademarks, the value thereof is determined based on the user's accumulated goodwill concerning the designated goods, having dynamic characteristics rather than recognizing the novelty of the mark itself as a value. Because of the characteristics, the value of a trademark right is determined according to the quantitative and qualitative values of the accumulated trademark use, so it takes a certain amount of time for a trademark to be recognized as a trademark of a specific person.
In modern society, where almost all information can be checked using the internet, it is an environment in which trademark information can be easily checked in local and abroad. Considering the situation, there is great room for trademark squatting problems for an unfair advantage. Paradoxically, information sharing between domestic and foreign patent offices is essential for solving the problems.
In this paper, it is presented a specific methodology that can be used by incorporating the Blockchain technology and Artificial Intelligence, the respective significant technology of the 4th industrial revolution, to solve intellectual property disputes, especially trademark disputes.
상표권은 표장 자체의 신규성과 같은 창작 자체를 가치로써 인정하는 것이 아닌, 해당 상품과 관련하여 사용되어 축적된 신용을 바탕으로 그 가치가 정해지는 ‘동적(動的)’인 특성을 가지고 있다. 이러한 특성 때문에 상표권의 가치는 축적된 상표 사용의 정량·정성적 수치에 따라 정해지므로 하나의 상표가 특정인의 상표로 인식되는 데에는 일정한 시간을 필요로 한다.
인터넷을 활용하여 거의 모든 정보를 확인할 수 있는 현대사회에서는 국내 및 국외에서 상표정보를 어렵지 않게 확인할 수 있는 환경이다. 이러한 상황을 고려해볼 때, 불법적 상표 선점 문제는 계속될 여지가 크다. 이러한 문제를 해결하기 위해서는 역설적이게도 국내 및 해외 특허청 간의 정보 공유가 필수적이다.
본 논문에서는 지식재산권 분쟁, 특히 상표 분쟁 사건을 해결하는 데에 4차 산업혁명의 주요 기술인 불리는 블록체인 기술과 인공지능을 접목하여 해결할 수 있는 구체적인 방법론을 제시한다.
