Although the number of patent applications is increasing every year, the scope of prior art search has expanded to known and shared technologies in foreign countries, making examination more difficult. In most countries require applicants to disclose information when applying for a patent to facilitate examination. In Korea, Article 42 (3) 2 was newly established through the revision of the patent law in 2011, and it was obligatory to provide background art in the specification. However, in 2017, a Supreme Court ruling was made to the effect that the background art described in the specification would not be regarded as a known prior art to the filing date, and there are changes in the treatment of background art when determining patentability. This led to doubts about the effectiveness of Article 42 (3) 2 of the Patent Law. Moreover, at this point, as it has been 10 years since its implementation, it is necessary to review whether it is having a positive effect on the efficiency of the review and is operating properly according to the original purpose of the revision. This article compares the information disclosure system of other IP5 countries, and proposes an amendment to Article 42 (3) 2 of the Patent Law for more effective information disclosure.
매년 특허 출원량은 증가하고 있고, 선행 기술 조사의 범위는 외국에서의 공지, 공용된 기술까지 확대되며 심사는 더욱 어려워졌다. 대부분의 국가에서 특허 출원 시 출원인에게 정보 개시를 요구하며 심사의 편의를 도모하고 있고, 우리나라에서도 2011년 특허법 개정을 통해 제42조 제3항 제2호를 신설하며 명세서에 배경 기술을 기재하는 것을 의무화하였다. 그러나, 2017년 명세서에 기재된 배경 기술을 출원일 이전에 공지된 기술로 보지 않겠다는 취지의 대법원 판결이 나오며, 특허성 판단 시 배경 기술에 대한 취급에도 변화가 있어, 특허법 제42조 제3항 제2호의 실효성에 의문을 품게 되었다. 더욱이 시행된 지 10년이 되어가고 있는 이 시점에서 본래의 개정 취지대로 심사 효율화에 긍정적인 영향을 주고 있는지, 제대로 운영되고 있는지 검토해볼 필요가 있다. 미국, 일본, 유럽 연합, 중국의 다른 IP5국의 정보 개시 제도와의 비교해보고, 더욱 효과적인 정보 개시를 위한 특허법 제42조 제3항 제2호의 개정안을 제안하고자 한다.
