In recent years, there has been a move to expand the protected object of each knowledge right. In this regard, it is possible to summarize the contents of the discussion on the discussion issues related to the functional principle in the industrial design right among intellectual property rights.
First, as a result of examining the discussions of the United States and Europe regarding the consideration of the functionality doctrine when determining the validity in the industrial design rights, when the non-aesthetic consideration test is adopted, there is a risk that the judgment criterion will be subjective. The alternative design approach can be seen as a desirable approach.
Second, as a result of examining the discussion between the United States and Europe in relation to the consideration of functionality doctrine when determining infringement in the industrial design rights, in the case of the United States, the comparison is based on aesthetic elements excluding functional elements, and in the case of Europe, when design is determined only by functional elements, functional elements are excluded, and in the other cases, the importance of functional elements is regarded as low when making similar judgments.
최근 각 지식재산권의 보호 대상을 확대하기 위한 움직임이 있다. 이와 관련해서 지식재산권 중 디자인권에서의 기능성 원리와 관련된 논의들을 살펴보면, 다음 두 가지 쟁점에 대한 논의 내용을 정리해 볼 수 있다.
첫째, 디자인권에서의 유효성 판단 시 기능성 원리 고찰과 관련하여 미국과 유럽의 논의를 살펴본 결과, 비 심미적 고려 테스트를 채택할 경우, 그 판단 기준이 자칫 주관적일 위험이 있기 때문에, 보다 객관적인 판단 기준인 대체디자인 접근법이 바람직한 접근법이라고 볼 수 있다. 이와 관련해서 대체 형상이 있는 경우와 대체 형상이 없더라도 심미적 요소가 포함되는 경우에 대해 모두 등록을 허여하는 것이 바람직하다고 할 것이다.
둘째, 디자인권에서의 침해 판단 시 기능성 원리 고찰과 관련하여 미국과 유럽의 논의를 살펴본 결과, 미국의 경우는 기능적 요소를 제외하고 장식적 요소 위주로 비교하여 판단하고, 유럽의 경우는 디자인이 기능적 요소에 의해서만 결정된 경우에는 기능적 요소를 배제하여 판단하고, 나머지 경우는 유사판단 시 기능적 요소의 중요도를 낮게 취급하여 판단하고 있다. 이와 관련해서 디자인이 기능적 요소에 의해서만 결정된 경우에 한해서 그 중요도를 낮게 보아 유사 판단하는 것이 디자인 전체관찰의 원칙에 부합하다고 할 것이다.
