Since Fair Use Regulations (Article 35-5 of the Copyright Act) first came into effect in Korea , domestic precedents have not yet been accumulated. And it is difficult to determine whether or not it is fair use when using computer program works. Therefore, when considering the characteristics of computer program works, US and UK legal regulations and precedents regarding the fair use of works, There is no need to easily admit fair use that computer program works are compared with poetry, novels, movies, etc. In other words, computer program works are not subject to protection as works when the copyright law was first introduced, but as functional works expressed in programming language with the development of computer technology. Considering the functional characteristics of program works and rapidly changing the software industry, I explained the criteria for determining fair use of computer program works that are differentiated from traditional works.
한국에 2013년 저작물의 공정이용 규정(저작권법 제35조의 5)이 최초 시행된 이후 해당 규정의 판단 기준에 대한 국내 판례가 아직 축적되지 않은 상황이며, 프로그램 저작물의 경우 그 판단 기준의 해석이 더욱 불명확한 바 프로그램 저작물의 이용 시 공정이용에 해당하는지 여부에 대한 판단이 어려운 실정이다. 이에 프로그램 저작물의 특성, 저작물의 공정이용에 대한 미국ㆍ영국의 법 규정 및 판례를 고려할 때, 프로그램 저작물은 저작권법이 최초 도입 시 저작물로 보호 받은 대상이 아니라 컴퓨터 기술의 발전에 따라 프로그램 언어로 표현된 기능성 저작물로 보호하게 된 것인 바, 프로그램 저작물만의 기능적인 특성과 급변하는 소프트웨어 산업을 고려하되 전통적인 저작물과는 차별화된 프로그램 저작물만의 공정이용 판단기준이 필요할 것으로 판단하였다. 판단기준 제1요소는 원 프로그램 저작물을 변형하여 새로운 기능의 프로그램 저작물을 창작했는지 여부, 제2요소는 이용된 프로그램 저작물의 개발 곤란성 및 창작 수준, 제3요소는 양적 비중 보다는 이용된 부분이 전체 원 프로그램 저작물에서 기능적으로 어떤 역할을 하는지 여부, 제4요소는 원 프로그램 저작물의 실질적인 시장 가치 영향을 기준으로 하되 잠재적인 시장이나 가치 영향은 저작권자에 증명 책임이 있다는 것이 판단기준 각 요소의 특징이다.
