Cosmeceuticals have been out of the range of existing whitening / wrinkle improvement / ultraviolet ray blocking, and its range has been increased to about 10 effects. However, the objective efficacy test method for newly designated functional cosmetics has not been established, objective indicators are required for the inventors to prove their effectiveness through in-vitro experiments. This study examines in vitro efficacy criteria, related laws, administrative standards, and patent statistics for existing Cosmeceuticals, and summarizes the criteria for progressive efficacy based on patent examination materials for new Cosmeceuticals guideline of KFDA
최근 기능성 화장품의 효능은 기존의 미백, 주름개선, 자외선 차단에 그치지 않고 약 10 가지로 그 효능 범위가 확장되었다. 그러나 탈모, 아토피, 여드름 등의 증상에 효능을 보이는 새로 지정된 기능성 화장품에 대한 객관적 효력 시험법이 아직 정립되지 않은 상황이며, 관능시험 외에 시험관내(in-vitro) 실험을 통하여 발명자들이 그 효과를 증명하기 위한 객관적 지표가 필요한 상황이다. 따라서 본 연구는 기존 기능성 화장품의 시험관내 효능 판단기준, 관련법제, 행정기준 및 관련 특허 출원 통계를 검토하고, 기능성 화장품의 특허 진보성 판단에 필수적인 시험관내 효능시험법의 활용빈도를 도출하여, 이의 식품의약품안전처의 기능성 화장품의 효력시험법 가이드라인으로서의 활용가능성을 고찰하였다.
