As the level of technology among the manufacturers of products is gradually leveled and the design for products is increasingly following the minimalist design that minimizes the decorations and minimize the mutuality, the overall appearance of shapes, shapes, and colors that make up the so-called trade dress is becoming more important. As a result, effective protection of trade dress has become necessary. However, considering the existing laws and practical cases in Korea, there is not enough protection for it. Therefore, in this study, the attitude of the current law and practice of Korea in relation to the protection of trade dress is examined, and the improvement plan for strengthening trade dress protection is suggested.
상품을 제조하는 업체들 간의 기술수준이 점차 평준화되어가고, 제품에 대한 디자인도 장식을 최대한 배제하고 상호 등을 최소화하는 미니멀리즘 디자인을 따르는 추세가 강해짐에 따라 수요자의 구매를 유인할 수 있는 요소로서 상품을 구성하는 형상, 모양, 색채 등의 총체적 외관, 이른바 트레이드 드레스(Trade Dress)의 중요성이 부각되고 있는 상황이다. 이에 따라 트레이드 드레스에 대한 실효성 있는 보호가 필요하게 되었는데, 우리나라 현행법 및 실무 사례를 검토해 볼 때, 이에 대한 보호가 미흡한 측면이 없지 않다. 따라서 본 연구에서는 트레이드 드레스의 보호에 대한 우리나라 현행법 및 실무의 태도를 살펴본 후 트레이드 드레스 보호 강화를 위한 개선 방안을 제시하고자 한다.
